Do I need to wait for the confidentiality review to apply for a patent abroad?
Under normal circumstances, you need to wait for the confidentiality review before you can apply for a foreign patent. However, there are exceptions: if the applicant does not receive the Notice of Opinions on Confidentiality Examination of Patent Application in Foreign Countries within four months from the date of filing the request, he may apply for a patent in foreign countries for the technical scheme. If the claimant does not receive the decision on the application for confidentiality review of foreign patents within six months from the date of filing the request, he may apply for a patent in a foreign country for the technical scheme. For an international application, if the applicant fails to send a notice of registration and retrieval within three months from the date of application, the applicant may apply for a patent abroad.
