First, prepare the application documents. Utility models and inventions include requests, specifications, claims, attached drawings of specifications and abstract of specifications. A patent for design shall contain a request, a picture or photograph and a brief explanation.
Step 2: Submit the materials. You can choose two ways to submit materials:
(a) directly to the patent office lobby or the local patent agency window.
(2) Submit by post. Then, the State Patent Office issued a notice of acceptance, which means that the patent application officially entered the examination and approval procedure. Step 4: Pay the application fee. In addition to paying directly at the toll office and agency of the Patent Office, you can also pay the application fee by remittance from the bank or post office. Pay attention to the payment within 15 working days from the date of receiving the admission notice.
After that, the Patent Office will conduct a preliminary examination of the application. For patent applications other than inventions, as long as they pass the preliminary examination, they can grant patents, and unqualified amendments can be resubmitted. Finally, after the approval of China National Intellectual Property Administration, the patent right can be granted.
Two. Duration of protection of intellectual property patent right
The term of the invention patent right is 20 years, and the term of the utility model patent right and the design patent right is 10 years, both counting from the date of application. The starting point of the patent protection period is not the patent announcement date, but the patent announcement date is the starting point for the patentee to obtain the patent right. The filing date of all kinds of patents is earlier than the announcement date, which means that the patent protection period enjoyed by the invention patentee is less than 20 years, and the patent protection period enjoyed by the utility model patentee and the design patentee is less than 10 years.
Three, the way to pay the patent application fee for intellectual property rights
The application fee and other fees can be paid directly to the toll office of the patent office or the patent agency, or remitted through the bank or post office. At present, banks use electronic transfer and post offices use electronic remittance. When paying the patent fee through the post office or bank, the payer shall indicate the correct application number or patent number on the money order, and the name of the paid fee shall be abbreviated. The remitter should ask the bank or post office staff to enter the above payment information in the remittance postscript column. If remittance is made through the post office, the post office staff must also enter the complete mailing address, including the postal code.
