The transfer of patent application right and patent right is essentially the change of the subject of patent application right and patent right. There are two main changes in this course:
The first situation occurs directly according to law due to the occurrence of legal time, such as the death of a natural person or the division or merger of a legal person or an unincorporated organization. In this case, the heirs and successors in line should explain the reasons to China National Intellectual Property Administration and attach relevant certificates to request the change of the subject of rights;
The second situation occurs because of the legal acts of the right subject, such as transfer and gift. In this case, the patent transfer contract should be registered and put on record according to the regulations.
