Patent designating country

(1) The PCT application was published internationally by the International Bureau from the priority date of 18 months, so there is no situation that it is published in some countries but not in some countries.

(2) According to the detailed rules revised in 2004, all designated countries are automatically designated when submitting the PCT application. Unless some designated countries are specifically excluded after the international application is filed, the PCT application enjoys the legal effect of general national application in all designated countries from the date of international application.

(3)PCT is only a patent application procedure, not a patent granting procedure, and the final authorization decision is made by each designated bureau. Therefore, only by obtaining the authorization of the designated bureau can the protection of patent rights be obtained.
