High-tech enterprises refer to resident enterprises that have formed core independent intellectual property rights through continuous research and development and transformation of technological achievements and registered in China (excluding Hong Kong, Macao and Taiwan) for more than 1 year. It is a knowledge-intensive and technology-intensive economic entity. According to the Administrative Measures for the Identification of High-tech Enterprises, the conditions for the identification of high-tech enterprises are as follows:
(1) year
Article 11 of the Identification Method means that an enterprise must be registered for more than one year, that is, it must be registered for more than 365 calendar days; "Current year", "previous year" and "previous year" all refer to the 1 fiscal year before the enterprise's declaration; "The last three fiscal years" refers to the three consecutive fiscal years before the enterprise's declaration (excluding the declaration year); "Within one year before the application is approved" means within 365 days before the application (including the reporting year).
(2) Intellectual property rights
1. The intellectual property rights involved in the identification of high-tech enterprises must be authorized or approved in China and within the effective protection period of China laws. The owner of intellectual property rights shall be the applicant enterprise.
2. Enterprises without intellectual property rights cannot be recognized as high-tech enterprises.
3. In the identification of high-tech enterprises, the classification evaluation method is used to evaluate the intellectual property rights of enterprises, in which: invention patents (including national defense patents), new plant varieties, national crop varieties, national new drugs, national first-class Chinese medicine protection varieties, and integrated circuit layout design exclusive rights are evaluated according to Class I; Utility model patent, design patent, software copyright, etc. (excluding trademarks) is rated as Class II.
4. Intellectual property rights assessed according to Class II can only be used once when applying for high-tech enterprises.
5. During the application period of high-tech enterprises and high-tech enterprises, when there are multiple rights holders of intellectual property rights, only one right holder can use it at the time of application.
6. The validity of the patent at the time of application for recognition shall be subject to the authorization certificate or authorization notice obtained by the enterprise before the application for recognition and the payment receipt can be provided.
7. Patents, trademarks and patent numbers of inventions, utility models, designs and layout designs of integrated circuits can be found on the website of China National Intellectual Property Administration;
The national defense patent shall provide the national defense patent certificate granted by China National Intellectual Property Administration;
New plant varieties can be found on the websites of the New Plant Variety Protection Office of the Ministry of Agriculture and the New Plant Variety Protection Office of the State Forestry Administration;
National crop varieties refer to crop varieties approved and published by the National Crop Variety Approval Committee of the Ministry of Agriculture;
National new drugs must provide a new drug certificate issued by the US Food and Drug Administration;
The national first-class protected varieties of traditional Chinese medicine must provide the certificate of protected varieties of traditional Chinese medicine issued by the US Food and Drug Administration;

(3) High-tech products (services) and main products (services)
High-tech products (services) refer to products (services) whose technology plays a core supporting role and fall within the scope of "high-tech fields supported by the state".
Main products (services) refer to high-tech products (services) with intellectual property rights that play a core supporting role in technology, and the sum of income accounts for more than 50% of the income of high-tech products (services) of enterprises in the same period.
