A utility model or design patent generally goes through the following procedures from application to authorization: 1. The applicant provides technical disclosure and entrusts a patent agency to write application documents. According to the requirements of the Patent Law, the agent writes the application documents with the largest scope of protection according to the applicant's invention content, and it usually takes about 10 -20 days for the agent to communicate with the applicant for confirmation. 2. After writing the application documents, submit the application documents, obtain the notification of acceptance from the Patent Office, and determine the application date. 3. The Patent Office conducts a formal examination of the patent application documents for about 3-8 months, and issues a notice of authorization after the preliminary examination is passed; 4. The applicant shall go through the formalities for obtaining the patent certificate; 5. It takes about 2-3 months to get the patent certificate. The whole process lasts about 1 year, and the specific time depends on the speed of the examiner's review and the informative degree of the applicant's disclosure materials. 2) Where the application documents intend to apply for a patent for utility model, the application documents shall include: the request for a patent for utility model, the abstract, the appended drawings of the abstract (if applicable), the specification, the claims and the appended drawings of the specification in duplicate. To apply for a patent for design, the application documents shall include a request for a patent for design, pictures or photographs (color pictures or photographs shall be submitted if color protection is required) and a brief description of the design in duplicate. If pictures are submitted, two copies shall be pictures; If photos are submitted, two copies are photos, and pictures or photos shall not be mixed.
