After the transferor and transferee of a trademark file a written application for transfer in accordance with the procedures stipulated in the Trademark Law, if both parties reach an agreement on revoking or temporarily failing to perform the trademark transfer, they may apply to the Trademark Office for withdrawal. Article 42 of China's Trademark Law stipulates that if a registered trademark is assigned, the assignor and the assignee shall sign an assignment agreement and apply to the Trademark Office. The transferee shall guarantee the quality of the goods using the registered trademark. When assigning a registered trademark, a trademark registrant shall assign an approximate trademark registered on the same commodity or an identical or similar trademark registered on similar commodities. The Trademark Office shall not approve the assignment that is likely to cause confusion or have other adverse effects, and shall notify the applicant in writing and explain the reasons. After the transfer of a registered trademark is approved, it shall be announced. The transferee shall enjoy the exclusive right to use the trademark from the date of announcement.
