What is the scope of the inheritance?

According to the provisions of China's inheritance law, the inheritance includes the following properties: ① the legal income of natural persons; (2) Houses and articles for daily use of natural persons; (3) Natural trees, livestock and poultry; (4) Cultural relics and books of natural persons; (5) The law allows natural persons to own the means of production; ⑥ Property right in natural person's copyright and patent right; ⑦ Other legal properties of natural persons mainly refer to various bills, securities and creditor's rights in the form of property.

However, the following property cannot be inherited as an inheritance: ① The contracted management right itself cannot be the object of inheritance, but can be inherited as an inheritance after the death of the heir. If the contractor wishes to continue the contract, it shall go through the formalities for changing the contract in accordance with the relevant provisions of the contract or the law. ② Personal exclusive property rights. ③ State-owned resources and the right to use homestead.

When determining the scope of the estate, we should pay attention to the following two issues: First, distinguish the estate of the decedent from the property owned by the decedent. The inheritance can only be the personal legal property of the deceased. When the heir is one of the property owners, the airport should separate its share from the property owned by * * * as inheritance. We can neither inherit all the property of * * * as an inheritance, nor ignore that part of the property owned by * * *. The Inheritance Law clearly stipulates that, unless otherwise agreed, half of the * * * and all the property acquired by husband and wife during the marriage relationship shall be divided into the property of the spouse, and the rest shall be the inheritance of the heir. The second is to distinguish the inheritance of the decedent from insurance and pension. For insurance money, if the insurance contract stipulates the beneficiary, the beneficiary will get the insurance money; If the beneficiary is not specified in the insurance contract, the insurance money can be inherited as an inheritance. As for the pension, if it is made by the relevant unit to the family of the deceased after the death of an employee or soldier on duty, due to illness or other accidents, it will have economic compensation for the family of the deceased and cannot be used as an inheritance. The living allowance given by the relevant departments to employees and soldiers who are disabled and unable to work due to work belongs to individuals, and this pension can be inherited as an inheritance.
