Since the mid-20th century, a new international trading system has been formed and advocated with GATT and its successor WTO as the center, which has promoted the process of economic globalization. At the same time, the intellectual property protection system has changed from the traditional domestic intellectual achievements to the intellectual property protection field of international market trade. The new international trade order has brought about problems in the international intellectual property system. The international trend of protecting intellectual property rights is not isolated. Intellectual property rights have been deeply integrated into international economic and trade relations and must be understood in the new international economic and trade system. China has become a member of the WTO. To participate in international trade and competition, it must act in accordance with the objectives and requirements of the WTO agreement. Strengthening intellectual property protection in foreign trade is one of them.

With the development of global integration of science, technology and economy, the importance of intellectual property rights in international competition is increasing day by day. Intellectual property, whether it is a patent, trademark, copyright, trade secret or new intellectual property in the traditional sense, is a civil right to human intellectual achievements from the legal point of view, an important intangible asset from the economic point of view, and a powerful competitive means in commodity production and operation activities from the market point of view, which is an important resource different from land, labor, capital and human resources. With the reform of China's economic system and the development of society, enterprises can equally obtain the funds, labor and other rich and varied means of production needed by social development, while technology is not only easy to be copied by other enterprises. In the era of knowledge economy, if enterprises want to survive and develop in the increasingly fierce competition and constantly improve their competitive strength, they must make technological progress and innovation, and know how to rely on the use of intellectual property rights to participate in market competition and win more market and development opportunities.

This paper introduces the concept of intellectual property in foreign trade, and puts forward some views by analyzing some problems of intellectual property protection in foreign trade in China at present.
