The winning bidder will set up a project company to be responsible for the financing, construction, operation, maintenance and management of Suixian urban sewage treatment plant project. After the stipulated franchise expires, the project company will hand over all the assets of Suixian urban sewage treatment plant to Suixian people free of charge. Interested potential bidders (hereinafter referred to as applicants) are specially invited to apply for prequalification.

3. Qualification requirements of the applicant

3.3 The bidder must have Grade B or above sewage operation qualification; The performance of sewage treatment facilities with a total treatment scale of not less than 65,438+0,000 tons/day (inclusive);
3.4 Professional execution ability: having the operation management ability, water quality detection ability and emergency handling ability required by sewage treatment business;
3.5 Having a corresponding number of personnel in key positions such as technology, finance and management; Having a practical business plan;

4. Pre-qualification method

Article 3 of the Law on Tendering and Bidding stipulates: "The following engineering construction projects in People's Republic of China (PRC), including engineering survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction, must be subject to tender: 1) large-scale infrastructure, public utilities and other projects related to social interests and public safety; (2) Projects that are wholly or partially invested with state-owned funds or financed by the state; (3) Projects using loans or aid funds from international organizations or foreign countries. The specific scope and scale standards of the projects listed in the preceding paragraph shall be formulated by the development planning department of the State Council in conjunction with the relevant departments of the State Council and submitted to the State Council for approval. If the law or the State Council has provisions on the scope of other projects that must be subject to tender, such provisions shall prevail. "
If the investors of the franchise project are selected and determined through bidding and can build, produce and provide by themselves according to law, the construction project may not be subject to bidding. On the contrary, if the investors of franchise projects are not selected and determined by bidding, such projects should be subject to bidding even if investors can build, produce and provide them by themselves according to law. (Editor's Note: The bidding for selecting investors is separate from the bidding for project construction. In fact, it is also explained from the side that not all franchise projects are determined by bidding, and some franchise projects are carried out by other means. If all franchise projects are carried out by bidding, the situation here should be described as "investors in franchise projects can build, produce or provide them by themselves according to law".
First of all, this paragraph, together with the Standard Provisions on the Scope and Scale of Bidding for Construction Projects (Order No.3 of the former State Planning Commission), stipulates the scope and scale standards of construction projects that must be subject to compulsory bidding according to law. Obviously, this requirement of compulsory bidding according to law is applicable to the project construction stage, that is, after the franchise investor is selected and the PPP project company is established, whether it is necessary to decide the builder through bidding for the project construction link in the project should be implemented according to the above provisions.
From the perspective of "Bidding Law" and "Implementation Regulations", there is no provision on whether PPP projects need to be invited for reasons of laws and administrative regulations. "The law can be done without prohibition." In China, bidding (including public bidding) does not have to grant the franchise of PPP projects, but can also be conducted by auction, competitive negotiation or even direct award.
