Why can't the patent be reduced after ten years?

BEIJING, Aug. 3 (Xinhua) According to the website of China National Intellectual Property Administration, China National Intellectual Property Administration stopped collecting and adjusting some patent fees from August 1 this year, stopped collecting patent registration fees and announcement printing fees, extended the annual fee reduction period for eligible patents, and applied for returning the substantive examination fees for some patent applications.

Specifically, the suspension and adjustment of some patent fees mainly involves three aspects:

One is to suspend the collection of patent registration fee, announcement printing fee, specification change fee (change of entrustment relationship between patent agency and agent) and transfer fee in patent application fee (international part) of Patent Cooperation Treaty (PCT). The above fees are July 3 1 2065438 before the expiration date of the payment period, and the payment is made according to the original regulations.

Second, for patent applicants or patentees who meet the relevant conditions in the Measures for Reduction and Payment of Patent Fees (Cai Shui [2016] No.78), the period for reduction and payment of patent annual fee is extended from 6 years in the year of authorization to 10 year. For patents that have been authorized to reduce fees before July 3, 20 18, the following treatment shall be made: within 6 years from the year of authorization, the annual fee reduction period shall be extended to 10; Within 7-9 years from the year of authorization, the annual fee will continue to be reduced from the following year until 10; The annual fee will not be reduced if it exceeds 10 years and 10 years from the authorized year.

3. Where an application for a patent for invention that has entered the substantive examination stage voluntarily applies for withdrawal before the expiration of the reply period of the first notice of examination opinions (except for the reply opinions submitted), it may request a refund of 50% of the fee for substantive examination of the patent application.

According to the above adjustments, China National Intellectual Property Administration revised the request forms such as Request for Fee Reduction and Statement of Opinions (on Fees), which were officially launched on August 1, and the old forms were also deactivated.
