Chongqing standardization regulations

Chapter I General Provisions Article 1 In order to strengthen standardization work, improve the quality of products and services, promote scientific and technological progress, promote high-quality economic and social development, and create a high-quality life, these Regulations are formulated in accordance with the Standardization Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the formulation, implementation and supervision of standards within the administrative area of this Municipality. Where laws, administrative regulations and the State Council decisions provide otherwise, such provisions shall prevail. Article 3 Standardization work shall adhere to the principles of government guidance, market drive, social participation and coordinated promotion. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall promote the implementation of the standardization strategy, incorporate the standardization work into the national economic and social development plan at the corresponding level, and incorporate the standardization work funds into the fiscal budget at the corresponding level.

The Municipal People's Government shall establish a standardization coordination mechanism, make overall plans to promote major standardization reforms and policy formulation in this Municipality, and coordinate major issues in standardization work. The people's governments of counties (autonomous counties) may, according to the needs of their work, establish a standardization coordination mechanism to co-ordinate and coordinate major issues in standardization work within their respective administrative areas. Article 5 The municipal standardization administrative department shall uniformly manage the standardization work in the whole city, be responsible for formulating local standards and supervise and guide the implementation of the standards. Encourage enterprises, social organizations, educational institutions, scientific research institutions and individuals to carry out or participate in standardization work and participate in international and national standardization activities. Article 7 The Municipal People's Government shall, in accordance with the relevant provisions of the state, establish a standardized regional cooperation mechanism with relevant provinces, autonomous regions and municipalities directly under the Central Government, such as the Belt and Road Initiative, the Yangtze River Economic Belt and the Chengdu-Chongqing Twin Cities Economic Circle, negotiate major standardization issues in the region, promote the integration of standards, and realize the coordinated development of regional economy, culture, society and ecological civilization.

Encourage social organizations and enterprises to carry out standardized cooperation with social organizations and enterprises in other regions to improve the efficiency of industrial synergy. Article 8 The relevant administrative departments of cities, districts and counties (autonomous counties) shall establish a mechanism combining standard research and development with scientific and technological innovation and industrial development.

Encourage the integrated development of standards and intellectual property rights, support the creation of standards, technologies, patents and brands, promote the transformation of scientific and technological achievements into standards, and foster the formation of well-known brands. Article 9 This Municipality shall establish a standard innovation reward system, and commend and reward units and individuals that have made remarkable achievements in standardization work in accordance with the relevant provisions of the State and this Municipality.

Standards with outstanding technological innovation, advanced technical and economic indicators, remarkable economic and social benefits or ecological and environmental benefits, and significant contributions to promoting scientific and technological progress in the industry and improving people's livelihood will be included in the scope of municipal science and technology awards as scientific and technological achievements.

Encourage the achievement of standard setting to be included in the evaluation indicators or conditions of professional titles as the performance of individual declaration of professional and technical qualifications. Chapter II Formulation of Standards Article 10 The formulation of standards shall be based on scientific and technological research results and social practical experience, and through in-depth investigation and argumentation and extensive solicitation of opinions, the scientific, normative, timely and instructive standards shall be ensured and the quality of standards shall be improved.

The formulation of standards should be conducive to the scientific and rational utilization of resources, the popularization of scientific and technological achievements, the enhancement of the safety, universality and substitutability of products and services, the improvement of economic, social and ecological benefits, and the achievement of advanced technology and economy. Eleventh in order to meet the local natural conditions, customs and other special technical requirements, the municipal standardization administrative department may formulate local standards in the fields of agriculture, industry, service industry and social undertakings.

For those who do not have the conditions to formulate local standards and need to unify technical requirements, the municipal standardization administrative department may organize the formulation of local standardization guidance technical documents. The validity period of the guiding technical documents for local standardization shall not exceed five years at the longest, and the procedures for formulating local standards stipulated in these Regulations shall apply. Twelfth local standards shall be formulated in accordance with the procedures of project establishment, organization drafting, technical review, approval, numbering, publication and filing.

In the process of formulating local standards, the opinions of stakeholders and the public should be widely solicited in various ways in accordance with the principle of convenience and effectiveness. Thirteenth municipal standardization administrative departments shall openly solicit local standard project proposals every year. The relevant municipal administrative departments shall, according to the requirements of the municipal standardization administrative department for soliciting local standard project proposals, summarize and study the project proposals of their own departments and industries, and submit an application for local standard projects to the municipal standardization administrative department. The municipal standardization administrative department shall organize the project demonstration, prepare the local standard formulation plan, and announce it to the public.

In order to protect major public interests or respond to emergencies, it is necessary to issue local standards in time, which can be quickly established and given priority.
