Children (heirs) can only inherit the personal legal property left by their parents. The so-called "personal legal property" includes the following items:

Is the owner of public houses a state or a collective? Therefore, after the death of the lessee, public houses as the lessee's property can not be inherited and divided, but can be leased by the same lessee or other relatives according to law, which is actually the inheritance of the lease right of public houses.
If the lessee of public housing dies, the lessee shall be determined according to the following provisions:

Two. If no agreement can be reached according to Article 1, the lessor may decide to replace the lessee among the residents of * * * in the following order:

3. Parents of the original lessee;
4. Others (according to the housing situation elsewhere and the length of residence here).
3. If there is no permanent residence in this city before the cohabitation, other spouses and immediate family members who have permanent residence in this city will continue to lease through consultation;
4. If no agreement can be reached according to Article 3, the lessor shall determine the lessee in the following order:
1, the spouse of the original lessee;
2. Children of the original lessee (according to their living conditions elsewhere);
3. Parents of the original lessee;
4. Other immediate family members of the original lessee (calculated separately according to the housing situation).
Note: * * * * cohabitant: refers to the person who actually lived in the rented house for more than one year (except in special circumstances) when the lessee of public housing dies or changes the lease relationship, and has no other housing in this city, or who has housing but has difficulties in living (marriage and childbirth are not subject to the above conditions).
