How to examine patent applications?
1. The patent reexamination claimant must be the applicant whose patent application has been rejected and the patentee whose patent right has been revoked, or the patentee who maintains the patent right or the claimant who revokes the patent right. No one else has the right to ask for a review. 2. Please confirm the review. You must make a request for reexamination within 3 months from the date of receiving the notice of rejection of the application by the Patent Office or the notice of revocation or maintenance of the patent right by the Patent Office, otherwise the relevant decision made by the Patent Office will take legal effect. 3. Where a request for reexamination is filed, a request for reexamination shall be submitted to the Patent Reexamination Board in duplicate, with reasons and relevant supporting documents attached. The reasons for reexamination can only be aimed at the matters involved in the decision of the Patent Office to reject the patent application or revoke or maintain the patent right, and no other irrelevant reasons and supporting materials may be put forward. 4. When the applicant or the patentee requests reexamination, he may modify the rejected patent application or the revoked patent document, but the modification shall be limited to the part involved in the decision to reject the application or revoke the patent right, and shall not exceed the scope recorded in the original specification and claims.
