China citizens whose patent agents meet the following conditions may sign up for the examination:
(1) Having full capacity for civil conduct;
(two) to obtain a college degree or above in science and engineering recognized by the state, and to obtain a diploma or degree certificate.
China citizens and residents of Taiwan Province Province who are permanent residents of the Hong Kong Special Administrative Region and the Macao Special Administrative Region may register for the examination. Twenty-second China citizens who have been engaged in patent examination for seven years may apply for exemption from patent agency practice.
Measures for the implementation of the examination:
Article 1 In order to standardize the qualification examination for patent agents, these Measures are formulated in accordance with the Patent Law of People's Republic of China (PRC) and the Regulations on Patent Agents.
Article 2 The patent agent qualification examination (hereinafter referred to as the examination) is a national unified patent agent qualification examination.
Article 3 China National Intellectual Property Administration is responsible for organizing examination, formulating examination policies and examination management systems, and guiding the examination work of the patent administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
Responsible for the examination proposition, the issuance of patent agent qualification certificates, the organization of roving examinations, the safety and confidentiality of examinations, the emergency handling of major emergencies nationwide, and the handling of disciplinary actions of candidates and examination staff.
China National Intellectual Property Administration sets up patent agent examination committee. The examination committee examines the examination outline and determines the qualified scores. The members are composed of relevant personnel from relevant departments of China National Intellectual Property Administration and the State Council, patent agency industry organizations and representatives of patent agents, and the director is China National Intellectual Property Administration. The office of the Examination Committee is responsible for the specific work of the examination.
