Legal analysis: If the applicant requires a grace period not to lose novelty, in addition to stating it in the request when filing the application, the applicant should also submit the following supporting documents within two months from the date of application:
(1) If it is exhibited for the first time at an international exhibition sponsored or recognized by the Chinese government, a certificate issued by the exhibition organizer indicating the date, location, name of the exhibition and the certificate of exhibition of the invention and creation shall be submitted. (2) If it is published for the first time at a prescribed academic conference or technical conference, it shall be submitted to the relevant competent department of the State Council or the national academic organization organizing the conference. Certification materials issued by a sexual group indicating the date, location, name of the meeting, and the date, form and content of the invention and creation, and stamped with the official seal;
(3) Others have not If the applicant agrees to disclose the contents, he shall submit certification materials indicating the date of disclosure, method of disclosure and content of the disclosure, and shall be signed or sealed by the certifier.
Legal basis: "Patent Law of the People's Republic of China" Article 24 The invention-creation for which a patent is applied for shall be filed within six months before the filing date (the priority date if it enjoys priority) ( We call this period the grace period for non-loss of novelty) Novelty will not be lost if one of the following circumstances occurs:
(1) It is first exhibited at an international exhibition sponsored or recognized by the Chinese government ;
(2) Published for the first time at a prescribed academic conference or technical conference;
(3) Others leak the content without the applicant's consent.
