Can I apply for a patent abroad?

Any unit or individual that applies to a foreign country for a patent for an invention or utility model completed in China shall report to the patent administration department in advance for confidentiality review. The procedures and time limit for confidentiality review shall be implemented in accordance with the provisions. Inventions or utility models that apply for patents in foreign countries in violation of the above provisions shall not be granted patents in China. Units or individuals in China may file an international patent application in accordance with the relevant international treaties to which People's Republic of China (PRC) is a party. The applicant who files an international application for a patent shall abide by the above provisions. The administrative department for patent shall handle international patent applications in accordance with the relevant international treaties to which People's Republic of China (PRC) is a party, the Patent Law of China and relevant regulations.
