Regulations on the Protection of the Rights and Interests of Overseas Chinese in Sichuan Province (2021 Revision)

Article 1: In order to protect the legitimate rights and interests of overseas Chinese, these regulations are formulated in accordance with the Constitution, relevant laws and administrative regulations, and in combination with the actual situation of Sichuan Province. Article 2: These regulations apply to the protection of the legitimate rights and interests of overseas Chinese within the administrative region of this province. Article 3 The term “overseas Chinese” as mentioned in these Regulations refers to Chinese citizens residing abroad.

The identity of overseas Chinese shall be confirmed by the agencies responsible for overseas Chinese affairs of local people's governments at or above the county level, in accordance with relevant national and provincial regulations, and based on the applicant's application. Article 4 The protection of the rights and interests of overseas Chinese shall follow the principle of equal protection. Overseas Chinese enjoy the civil rights stipulated in the Constitution, laws and regulations, and perform the civil duties stipulated in the Constitution, laws and regulations. Article 5: Overseas Chinese are encouraged to leverage their advantages of being well-connected with China and foreign countries and having extensive connections, to participate in and serve the economic and social construction of the province, and to play a role as a bridge and link in opening up, cooperation and exchanges, and friendly people-to-people exchanges. Article 6: Local people's governments at or above the county level shall strengthen leadership over the protection of the rights and interests of overseas Chinese, organize and supervise relevant departments to do a good job in protecting the rights and interests of overseas Chinese, and provide necessary funding guarantees for the protection of the rights and interests of overseas Chinese based on actual work needs.

The agencies responsible for overseas Chinese affairs of local people's governments at or above the county level are responsible for the overall planning, coordination, guidance, supervision and publicity of the protection of the rights and interests of overseas Chinese within their respective administrative regions.

Other relevant departments of the local people's governments at or above the county level shall do a good job in protecting the rights and interests of overseas Chinese in accordance with their respective responsibilities. Article 7: Local federations of returned overseas Chinese at all levels carry out activities in accordance with their charters, reflect the opinions and demands of overseas Chinese, do a good job in resolving disputes involving overseas Chinese and providing legal services, and safeguard the legitimate rights and interests of overseas Chinese. Article 8 When overseas Chinese handle matters such as finance, education, medical care, transportation, communications, social insurance, property registration, market entity registration, tax registration, accommodation registration, etc. in this province, if they need to provide proof of identity, they can present a valid ID card held by them. The passport of the People's Republic of China proves his identity.

If an overseas Chinese requests expedited application for entry-exit documents due to reasonable emergencies, the exit-entry management agency of the public security organ shall handle it in a timely manner.

Relevant departments and units should take measures to improve relevant information systems and provide convenient services for overseas Chinese to handle relevant matters in accordance with relevant national and provincial regulations. Article 9: Encourage and support overseas Chinese to invest and start businesses in this province. Guide overseas Chinese to leverage their advantages in talent, technology, and capital to invest and start businesses in the province's key industries, advantageous and characteristic industries, and other encouraged development areas.

Overseas Chinese can contribute money in currency, or in kind, intellectual property rights, land use rights and other non-monetary properties that can be valued in currency and transferred in accordance with the law. Exceptions are made for property that cannot be used as capital contribution according to laws and administrative regulations.

When overseas Chinese invest in this province, the market access negative list system shall be applied in accordance with the law. Article 10: Overseas Chinese-invested enterprises that have been approved and registered shall enjoy various preferential treatments provided by the state and the province to encourage foreign investment.

High-tech enterprises invested and established by overseas Chinese in this province and enterprises in industries encouraged by the Western Development Development enjoy preferential tax policies in accordance with relevant regulations.

Encourage financial institutions to provide credit support to overseas Chinese-invested enterprises that meet loan conditions. Article 11: Support overseas Chinese and overseas Chinese-invested enterprises in patent applications, trademark registrations, copyright registrations and other activities. Support overseas Chinese and overseas Chinese-invested enterprises to conduct intellectual property evaluation, registration, trading, transfer and other activities through the intellectual property transfer and trading market.

Protect the patent rights, trademark rights, copyrights and other intellectual property rights of overseas Chinese and overseas Chinese-invested enterprises in accordance with the law. For the creation and application of major invention patented technologies involving economic and social development, policy and financial support will be provided in accordance with relevant national and provincial regulations. Article 12 Overseas Chinese investors who use patents, scientific research results, proprietary technologies, etc. to establish enterprises shall enjoy the relevant policies for overseas students returning to their country to start their own businesses.

Overseas Chinese who come to this province to start businesses and find jobs and meet the conditions stipulated by the country and this province can enjoy preferential policies or convenient services in government affairs, finance, scientific research, housing, medical care, transportation, education, etc. Article 13 The property, intellectual property rights, investment income and other legitimate income invested by overseas Chinese investors in this province may be transferred or inherited in accordance with the law. Article 14 The profits, dividends, dividends, rents, funds after liquidation and other legal gains obtained by overseas Chinese investors from investing and operating in this province can be converted into foreign exchange in accordance with the law and remitted abroad.

The wages and other legal income of overseas Chinese employees can be remitted or carried out of the country in accordance with the law.

Article 15 Overseas Chinese-invested enterprises participating in government procurement and government-organized bidding in this province shall enjoy the same treatment as other enterprises, and no organization or individual may impose differential or discriminatory treatment on them. Article 16: Encourage and support overseas Chinese, overseas Chinese-invested enterprises and overseas Chinese social groups to donate property for public welfare undertakings in accordance with the law, and their public welfare donation expenditures shall enjoy national tax incentives in accordance with the law.

Imported materials for public welfare donated by overseas Chinese to public welfare social groups and public welfare non-profit institutions in this province are subject to reduced or exempted import tariffs and value-added import links in accordance with the provisions of laws and administrative regulations. Tax.

The protection of rights and interests related to overseas Chinese donations shall be implemented in accordance with relevant laws and regulations. Article 17 Overseas Chinese who have made outstanding contributions to the economic development, social construction, and open cooperation of the country and the province shall be commended or rewarded in accordance with the relevant regulations of the country and the province.
