The patent applied by the first country is called patent application priority.

The so-called priority means that an applicant can enjoy the right to be ahead of other applicants when filing a patent application on the same subject in other countries within a certain period of time after filing a patent application for the first time in one country, that is, the date of filing an application in the first country is taken as the filing date in that country.

China's patent law has made the following provisions on foreign priority and domestic priority.

(1) foreign priority refers to "an applicant who applies for a patent for an invention or utility model for the first time in a foreign country within twelve months, or for a design for the first time in a foreign country within six months, and at the same time applies for a patent for the same subject in China, may enjoy priority according to the agreement signed by the foreign country with China or the international treaties to which both countries are parties, or according to the principle of mutual recognition of priority."

(2) Domestic priority means that an applicant who files an application for a patent for invention or utility model with the Patent Office within 12 months from the date when he first filed an application in China can enjoy priority. However, one of the following circumstances in the previous application cannot be used as the basis for claiming domestic priority: A has claimed foreign priority or domestic priority; Party B has been approved to grant the patent right; C is required for branch application.
