Article Chapter 1 General Provisions

Article 1 These regulations are formulated in accordance with the relevant provisions of the Constitution of the People's Republic of China and the Military Service Law of the People's Republic of China.

Article 2: In order to strengthen the revolutionization, modernization, and regularization of the Chinese People's Liberation Army, facilitate the command and management of the army, and enhance the officers' sense of responsibility and honor, an officer rank system is implemented.

Article 3: Officer rank is the title and symbol that distinguishes the rank of an officer, indicates the identity of an officer, and is the honor given to officers by the country. Article 4 Officer ranks are divided into active duty officer ranks and reserve officer ranks according to the nature of the officer's service.

Article 5: Between an officer with a higher military rank and an officer with a lower military rank, the one with the higher military rank is the superior. When an officer with a higher rank is functionally subordinate to an officer with a lower rank, the officer with the higher rank is the superior.

Article 6 If an active-duty officer is transferred to reserve service, his military rank will be preceded by "reserve service." If an active-duty officer retires, his or her military rank will be retained, and "retired" will be prefixed to his or her military rank.

(2) Colonel: Colonel, Colonel, Lieutenant Colonel, Major;

(3) Lieutenant: Captain, Lieutenant, Second Lieutenant.

Article 8: Officer ranks are distinguished according to the following provisions:

(1) Military, political, and logistics officers:

General, lieutenant general, major general, senior colonel , colonel, lieutenant colonel, major, captain, lieutenant, second lieutenant.

Navy and Air Force officers are preceded by "Navy" and "Air Force" respectively in their military ranks.

(2) Professional and technical officers:

Lieutenant general, major general, senior colonel, colonel, lieutenant colonel, major, captain, lieutenant, and second lieutenant.

Be preceded by "professional skills" in military ranks.

Chapter 3: Establishment of Military Ranks by Position and Rank of Active-duty Officers Article 9: The People's Liberation Army implements a gradation and establishment of military ranks by officers' positions.

Article 10 The Central Military Commission of the People’s Republic of China leads the national armed forces. The Central Military Commission implements the chairman's responsibility system.

The Chairman of the Central Military Commission is not awarded a military rank;

The position of the Vice Chairman of the Central Military Commission is general.

The rank of members of the Central Military Commission is general.

Article 11 Military, political, and logistics officers shall be assigned the following job grades:

Chief of General Staff and Director of the General Political Department of the People's Liberation Army: General;

Chief military region positions: general, lieutenant general;

Deputy military region positions: lieutenant general, major general;

Chief military position: major general, lieutenant general;

Deputy military positions: major general, senior colonel;

Major military positions: senior colonel, major general;

Deputy military position (brigade position): colonel, senior colonel;

Regimental rank (deputy brigade rank): colonel, lieutenant colonel;

Deputy regimental rank: lieutenant colonel, major;

Bachelor battalion rank: major, lieutenant colonel;

Deputy regimental rank: lieutenant colonel, major; p>

Deputy battalion positions: captain, major;

Corporate positions: captain, lieutenant;

Deputy company positions: lieutenant, captain;

Ranking: second lieutenant, lieutenant.

Article 12 Professional and technical officers shall be organized into military ranks according to the following job levels:

Senior professional and technical positions: Lieutenant General to Colonel;

Intermediate professional and technical positions: Senior colonel to captain;

Junior professional and technical positions: lieutenant colonel to lieutenant.

Chapter 4: First Grant of Military Ranks to Active-duty Officers

Article 13: Officers’ ranks shall be awarded in accordance with the ranking system of officers’ positions.

Article 14: The award of military ranks to officers shall be based on the officer’s position, performance of moral integrity, work performance, contribution to the revolutionary cause and experience in serving in the army.

Article 15 Personnel who first assume the position of military officers shall be awarded military ranks for the first time in accordance with the following provisions:

(1) Those who graduate from military secondary vocational schools shall be awarded the rank of second lieutenant;

Those who graduate from a junior college are awarded the rank of second lieutenant, and may be awarded the rank of lieutenant in accordance with the relevant regulations of the General Political Department of the People's Liberation Army;

Those who graduate from a college degree are awarded the rank of lieutenant, and may be awarded the rank of lieutenant in accordance with the relevant regulations of the General Political Department of the People's Liberation Army Awarded the rank of second lieutenant;

Those who have obtained a master's degree will be awarded the rank of captain, and may be awarded the rank of lieutenant in accordance with the relevant regulations of the General Political Department of the People's Liberation Army;

Those who have graduated from the graduate class but have not obtained a master's degree , awarded the rank of lieutenant;

Those who obtain a doctorate degree will be awarded the rank of major, and those who obtain the doctorate may be awarded the rank of captain in accordance with the relevant regulations of the General Political Department of the People's Liberation Army.

(2) If a soldier is appointed to an officer position during wartime, the military ranks shall be compiled according to the officer position level and the corresponding military rank shall be awarded.

(3) If military civilian cadres and personnel from non-military departments are appointed to officer positions, military ranks will be compiled according to the officer position levels and the corresponding military ranks will be awarded.

Article 16 The first grant of military ranks to military officers shall be approved in accordance with the authority specified below:

(1) General, lieutenant general, major general, senior colonel and colonel shall be approved by the Central Military Commission Awarded with the approval of the Chairman;

(2) Lieutenant Colonel and Major shall be approved and awarded by the head of each headquarters, major military region, service branch or other equivalent unit of the People's Liberation Army at the level of major military region;

(3) Captains, lieutenants, and second lieutenants shall be awarded with the approval of the head of a group army or other military-level unit with the power to appoint and remove officers.

Chapter 5 Promotion of Active-duty Officers’ Ranks Article 17 Officers’ ranks are promoted according to the following deadlines:

(1) Period for promotion of officers’ ranks in peacetime: second lieutenant to lieutenant, college junior college or above It takes two years for those who graduate, and three years for others;

It takes four years each for lieutenant to captain, captain to major, major to lieutenant colonel, lieutenant colonel to colonel, and colonel to senior colonel;

Promotion to the rank of colonel or above is based on selection and promotion, based on the officer's position, performance of moral integrity and contribution to national defense construction.

(2) The period for promotion of officer ranks during wartime may be shortened, and the specific measures shall be prescribed by the Central Military Commission based on wartime conditions.

The time an officer spends studying in academies is calculated into the period for promotion to military rank.

Article 18 Officers’ ranks shall generally be promoted step by step according to the prescribed period.

Article 19: If an officer's promotion period expires and he or she violates military discipline and does not meet the qualifications for promotion in accordance with the relevant regulations of the Central Military Commission, his or her promotion will be postponed or he will be retired from active service.

Article 20 If an officer's military rank is lower than the lowest rank in the establishment of the new position due to promotion of his position, he shall be promoted to the lowest rank in the establishment of the new position in advance.

Article 21: If an officer makes outstanding achievements in combat or work, his or her military rank may be promoted in advance.

Article 22 If an officer who is appointed as vice chairman or member of the Central Military Commission is promoted to general, he shall be awarded the rank of general by the Chairman of the Central Military Commission.

Article 23 Promotions to military officer ranks other than those specified in Article 22 of this Law shall be approved in accordance with the appointment and removal authority of officer positions.

However, the promotion of the following officer ranks shall be approved in accordance with the following regulations:

(1) If an officer with deputy divisional rank (brigade rank) is promoted to senior colonel, and if a professional technical officer is promoted to senior colonel, major general, or lieutenant general, the promotion shall be made by Approval by the Chairman of the Central Military Commission;

(2) The promotion of professional and technical officers to colonels shall be approved by the heads of the People’s Liberation Army headquarters, major military regions, services or other units equivalent to the major military region level;

(3) The promotion of deputy battalion officers to major, and the promotion of professional and technical officers to major or lieutenant colonel must be approved by the head of the group army or other military-level units with the power to appoint and remove officers.

Chapter 6 Demotion, Cancellation and Deprivation of Ranks of Active-duty Officers Article 24 If an officer is transferred to a lower-level position due to incompetence for his current position, and his military rank is higher than the highest military rank of the new position, he shall Adjusted to the highest military rank in the new job grade establishment. The approval authority for adjusting the military rank is the same as the approval authority for the original military rank.

Article 25 If an officer violates military discipline, he may be demoted in rank in accordance with the relevant regulations of the Central Military Commission. The authority to approve a downgrade in rank is the same as the authority to approve the first grant of that rank.

Office downgrade does not apply to second lieutenant officers.

Article 26: If an officer's military rank is downgraded, the period of promotion will be recalculated based on the downgraded military rank.

After an officer is demoted, if he has corrected his mistakes and has made remarkable achievements in combat or work, the period for promotion of his military rank may be shortened.

Article 27: Those who have their officer positions revoked and their officer status revoked will have their officer rank revoked. The authority to approve the removal of an officer's rank is the same as the authority to first approve the conferment of that rank.

If an officer is dismissed from the military, his military rank will be revoked. The authority to approve the cancellation of military rank is the same as the authority to approve dismissal from the military.

Article 28 If an officer commits a crime and is sentenced to deprivation of political rights or a fixed-term imprisonment of more than three years in accordance with the law, the court shall decide to deprive him of his military rank. If a retired military officer commits a crime, his military rank shall be deprived in accordance with the provisions of the preceding paragraph.

If an officer commits a crime and is deprived of his military rank. After serving his sentence, if he needs to serve in the army and be awarded the rank of an officer, the provisions of Article 16 of these Regulations shall apply.

Chapter 7 Symbols and Wearing of Ranks of Active-duty Officers

Article 29 The epaulettes, symbol styles and wearing methods of officer ranks shall be promulgated by the Central Military Commission.

Article 30: The epaulettes and symbols worn by officers must match their military ranks.

Chapter 8 Supplementary Provisions

Article 31 The rank system for reserve officers shall be separately stipulated.

Article 32 The military rank system for soldiers shall be stipulated by the State Council and the Central Military Commission.

Article 33 The Chinese People’s Armed Police Force shall implement a police rank system, and the specific measures shall be prescribed by the State Council and the Central Military Commission.

Article 34 The General Staff Headquarters and the General Political Department of the People's Liberation Army shall formulate implementation measures in accordance with these Regulations and submit them to the Central Military Commission for approval before implementation.

Article 35 These Regulations shall come into effect on the date of promulgation.
