What is the application process for Japanese trademarks?

Japanese trademark registration procedures can be roughly divided into four stages: application, examination, announcement/objection and registration. The whole registration cycle takes 6-8 months, without objection.

1.? Registration process and time required

(1) Application stage (receipt will be received in about 7 days)

You can receive the receipt of Japanese trademark registration about 7 days after submission.

(2) Review period (4-6 months)

Japanese trademark review is divided into two parts: formal review and substantive review.

Formal review: after submitting the application, give the application number and confirm the application time. At this stage, whether the application documents meet the requirements is reviewed.

Substantive examination: examining whether a trademark can be registered according to law, for example, whether it is significant. If the examiner thinks that the trademark is not suitable for registration, he will issue a notice of rejection. The applicant can give a reply within the specified time. The applicant may also apply for an extension of the reply time.

(3) Announcement/Objection Stage (2 months)

After the trademark has passed the examination, the applicant will be informed that the trademark application has been accepted and published in the trademark announcement. Anyone can raise objections, state reasons and submit relevant evidence within the two-month announcement period.

(4) Registration stage

A trademark that can be registered after an objection ruling, or a trademark that has been announced without objection, shall be granted registration and a registration certificate shall be issued.

2.? Problems needing attention after trademark registration

The validity period of Japanese trademarks is 10 year from the date of registration. If you need to continue to use it after the expiration of the validity period, you should apply for renewal of registration six months before the expiration of the registration period, and the validity period of each renewal of registration is 10 year; There is a grace period of 6 months for trademark renewal, but an extra fee is required.
