Main work in the past year
In 2008, in the face of major difficulties and severe challenges, the CPC Central Committee with Comrade Hu Jintao as the general secretary United and led the people of all ethnic groups throughout the country to work hard with one heart and one mind, won a major victory in all-round disaster relief, successfully hosted the Beijing Olympic Games and Paralympics, successfully completed the Shenzhou VII manned space mission, and solemnly commemorated the 30th anniversary of reform and opening up. The economy has maintained rapid growth, people's livelihood has been further improved, the overall social situation has remained stable, and Socialism with Chinese characteristics's international status has been further enhanced and new great achievements have been made.
The past year was the first year for the 11th the National People's Congress Standing Committee (NPCSC) to perform its duties according to law. We fully implement the spirit of the 17th National Congress of the Communist Party of China and the Third Plenary Session of the 17th Central Committee, take Deng Xiaoping Theory and Theory of Three Represents as the guidance, thoroughly implement Scientific Outlook on Development, adhere to the organic unity of the party's leadership, the people being the masters of the country and governing the country according to law, closely focus on the overall situation of the work of the party and the state, firmly grasp the outstanding problems in economic and social development, exercise their functions and powers according to law, actively carry out their work, and give full play to the role of state power organs. Over the past year, * * * has deliberated a total of five legal cases 15, passed nine cases, listened to and deliberated three work reports 13 from the State Council, the Supreme People's Court and the Supreme People's Procuratorate, made three resolutions, checked the implementation of five laws, decided to ratify 20 treaties, agreements and international conventions concluded by China with foreign countries, and decided and approved the appointment and dismissal of a number of people for socialist economic construction and politics.
First, fully support earthquake relief and post-disaster recovery and reconstruction.
The devastating earthquake in Wenchuan, Sichuan Province on May 2 last year caused great losses to people's lives and property in the disaster areas, and also had a serious impact on the country's economic and social development. This disaster affects the hearts of people of all ethnic groups throughout the country. The National People's Congress Standing Committee (NPCSC) took urgent action, conscientiously implemented the central government's plan, strengthened supervision and legislative work according to the characteristics of the work of the National People's Congress, fully supported earthquake relief and post-disaster recovery and reconstruction, and gave full play to the political advantage of the socialist system in concentrating on doing great things.
First, adjust the work plan in time. On May 22nd last year, a special meeting of chairmen was held to listen to the State Council's report. In order to highlight the key work and support the State Council to concentrate on earthquake relief, it was decided to adjust the work plan of the Standing Committee, and the State Council's report on earthquake relief and post-disaster recovery and reconstruction and the central budget adjustment plan for 2008 were included in the agenda of the Standing Committee meeting in June. It was decided to adjust the agenda of the central final accounts and audit report, and the review and approval of the central final accounts in 2007, which were considered as usual at the June meeting, to the August meeting. In order to have enough time to absorb the beneficial experience accumulated in earthquake relief, transitional resettlement and post-disaster recovery and reconstruction into relevant laws, it is decided to adjust the revised draft of the earthquake prevention and disaster reduction law originally planned to be considered at the June meeting for consideration.
Second, resolutely implement the decision of the CPC Central Committee to concentrate financial resources on earthquake relief. In order to ensure the financial needs of earthquake relief and post-disaster recovery and reconstruction, the chairman's meeting on May 22nd made it clear that people's livelihood in disaster areas should be guaranteed. Starting from the reality of earthquake relief, it was proposed to transfer most of the funds from the central budget stabilization fund to establish a post-disaster recovery and reconstruction fund, and incorporate and adjust the central budget according to the actual income and expenditure of the fund, and report it to the National People's Congress Standing Committee (NPCSC) for examination and approval according to law; Before the budget adjustment plan is approved, the required funds can be allocated from the central treasury to ensure the timely disbursement of funds for earthquake relief and post-disaster recovery and reconstruction. At the same time, it is required to strengthen the audit and supervision of the use of funds, and it is suggested to arrange the funds needed for the next work as soon as possible. At the meeting of the Standing Committee in June, the central budget adjustment plan for 2008 was reviewed and approved, and the post-disaster recovery and reconstruction fund was agreed to be established, which provided financial guarantee for the smooth progress of earthquake relief and post-disaster recovery and reconstruction. It is also suggested that relevant parties should formulate post-disaster recovery and reconstruction plans and specific implementation plans as soon as possible, clarify relevant policies, and support post-disaster reconstruction and production self-help in many ways.
Third, in the case of fully investing in earthquake relief, we should pay attention to earthquake relief on the one hand and economic and social development on the other to ensure the completion of the annual tasks. On June 26th, the Standing Committee made a special resolution to positively evaluate the remarkable achievements made in the earthquake relief work, fully affirmed the work of the State Council, local governments and all aspects, and demanded to continue to spare no efforts to rescue the wounded, properly resettle the affected people and solidly promote post-disaster recovery and reconstruction. During the deliberation, members of the Standing Committee pointed out that the Wenchuan earthquake in Sichuan and the severe low-temperature rain, snow and freezing disasters in parts of southern China at the beginning of the year brought great difficulties to the economic work throughout the year. Under the difficult situation, it is even more necessary to follow the central government's decision-making arrangements, pay attention to earthquake relief on the one hand and economic and social development on the other, attach great importance to, timely study and effectively solve outstanding contradictions in economic operation, and strive to win double victories in earthquake relief and economic and social development. At the same time, we should make good preparations for the Beijing Olympic Games, eliminate interference, and ensure that the Beijing Olympic Games will become a distinctive and high-level Olympic Games.
The fourth is to comprehensively revise the earthquake prevention and disaster reduction law. The revised draft of the Law on Earthquake Prevention and Disaster Mitigation was first deliberated at the meeting of the Standing Committee in June 5438+ 10, and was released to the public for comments through major news media. * * * received more than 7,300 comments and suggestions. Relevant special committees timely organize capable personnel to go to the disaster areas for on-the-spot investigation, and fully listen to the opinions of frontline cadres and masses in earthquake relief. According to the opinions of all parties, the Standing Committee has made major revisions to the Law on Earthquake Prevention and Disaster Mitigation, raised the seismic fortification standards of construction projects, especially public facilities such as schools and hospitals, improved the earthquake emergency rescue system, and strengthened the institutional measures for post-disaster transitional resettlement and post-disaster recovery and reconstruction.
Second, actively promote sound and rapid economic development.
It is a focus of the Standing Committee's work to thoroughly implement Scientific Outlook on Development and promote sound and rapid economic development. In our work, we seize the outstanding problems in economic and social development, comprehensively use various forms of supervision, strengthen follow-up supervision, promote improvement, and improve the legal system, so as to make NPC work deeper and more dynamic.
The first is to promote the implementation of the central government's major macro-control decisions and arrangements. Since last year, faced with the complicated and changeable international economic situation and outstanding contradictions and problems in domestic economic operation, the CPC Central Committee has timely adjusted the primary task of macro-control from "two defenses" at the beginning of the year, that is, preventing rapid economic growth from becoming overheated and structural price increases from becoming obvious inflation, to "one guarantee and one control" in the middle of the year, that is, maintaining steady and rapid economic growth and controlling excessive price increases. In response to the rapid spread of the international financial crisis, in June 165438+ 10, a series of policies and measures were adopted to expand domestic demand and promote economic growth.
In order to ensure the implementation of the central government's major decision-making arrangements, the Standing Committee, in addition to hearing and deliberating the report on strengthening financial macro-control and stabilizing prices as planned, specially arranged to hear and deliberating the State Council's report on coping with the international financial crisis and ensuring the steady and rapid development of the national economy in the face of the new situation of the international financial crisis in February. During the deliberation, members of the Standing Committee fully affirmed the State Council's work. At the same time, it is pointed out that the current international financial crisis continues to spread, its impact on China's real economy continues to deepen, and the external economic environment for China's development is becoming increasingly severe. In the case of insufficient effective demand, some deep-seated contradictions and problems in China's economic and social development will become more prominent. We must earnestly enhance our sense of hardship, unify our thoughts and actions with the central authorities' analysis and judgment of the situation and overall deployment of work, fully implement the spirit of the Central Economic Work Conference, turn severe challenges into development opportunities, turn market pressure into adjustment motivation, and take accelerating the transformation of economic development mode and structural adjustment as the main direction while maintaining steady and rapid economic development. It is emphasized that in the case of overcapacity in many industries, the most important thing to implement a proactive fiscal policy and a moderately loose monetary policy is to strictly grasp the policy and investment orientation, prevent low-level redundant construction and prevent a new round of blind urban expansion.
In order to ensure the smooth implementation of the proactive fiscal policy, according to the relevant provisions of the budget law, it is suggested that the new investment in 2008 should be charged from the surplus income of the central budget in that year and reported to the National People's Congress Standing Committee (NPCSC) according to law; Agree to arrange a certain proportion of funds before the National People's Congress approves the 2009 central budget to ensure the capital demand of key construction projects, and implement it according to the approved budget after the budget is approved; It is suggested that the local government bonds issued by the Ministry of Finance with the approval of the State Council in 2009 should be included in the local fiscal budget and reported to the people's congress at the same level or its standing committee for approval.
The second is to promote the transformation of economic development mode. Accelerating the transformation of economic development mode and promoting the optimization and upgrading of industrial structure are urgent and significant strategic tasks related to the overall situation of the national economy. In February 65438, the meeting of the Standing Committee specially listened to and deliberated the State Council's report on the mid-term implementation of the 11th Five-Year Plan. During the deliberation, the members of the Standing Committee fully affirmed the achievements, objectively analyzed the problems, put forward pertinent suggestions, and pointed out that from the evaluation situation, most of the indicators determined in the outline met the expected progress requirements and the implementation was generally good. However, among the four indicators reflecting the economic structure, the added value of service industry, the number of employees in service industry and R&D funds failed to meet the expected progress requirements; The energy consumption per unit GDP, the total discharge of major pollutants and other two major binding indicators are far from the planning objectives. To a great extent, this shows that China's economic development mode has not fundamentally changed, the industrial structure is still dominated by industry, the demand structure is still dominated by exports and investment, and the problems such as increasing pressure on resources and environment, increasing difficulty in expanding employment and insufficient consumption are still outstanding. It is suggested that the State Council and relevant departments attach great importance to the existing problems, speed up the "three transformations" of economic development mode in accordance with the spirit of the 17th National Congress of the Communist Party of China, intensify their work, and strive to achieve the objectives and tasks set in the 11th Five-Year Plan. The Standing Committee also urged governments at all levels and relevant parties to implement the Scientific Outlook on Development, change the mode of economic development, formulate a circular economy promotion law, amend the patent law, listen to and consider the State Council's report on water pollution prevention and control, and carry out law enforcement inspection of environmental impact assessment law.
The third is to promote rural reform and development. Doing a good job in "agriculture, countryside and farmers" is related to the overall development of the cause of the party and the state. The last Standing Committee followed and supervised the "three rural issues" for five consecutive years and achieved remarkable results. Last year, when listening to and deliberating the State Council's report on promoting the steady increase of farmers' income and related reports, the Standing Committee put forward important suggestions for doing a good job in "agriculture, countryside and farmers". In carrying out law enforcement inspection of farmers' professional cooperatives, the Standing Committee has a deep understanding of the development and main problems of various farmers' professional cooperatives, and demands the full implementation of various support policies stipulated by law, so that farmers' professional cooperatives can play a greater role in improving farmers' organization and leading farmers to participate in domestic and international market competition. Through the supervision of the National People's Congress, the construction of a new socialist countryside has been effectively promoted. With the joint efforts of the State Council, local governments at all levels and farmers, the per capita net income of rural residents increased by 8% in 2008, and the total grain output and yield reached a new record high. By the end of 2008, there were more than 1 10000 farmers' professional cooperatives in China, with more than 140000 registered members. The annual income of farmers who join cooperatives is more than 20% higher than that of non-member farmers. While fully affirming the achievements, the members of the Standing Committee pointed out that we should attach great importance to the problems such as the overall income level of farmers is still low, the income gap between urban and rural residents continues to widen, the comparative benefits of agriculture are still declining, the agricultural infrastructure is backward, and farmers are facing new difficulties. Solidly promote rural reform, substantially increase investment in agriculture, rural areas and farmers, strictly protect cultivated land, gradually rationalize the prices of agricultural products such as grain, constantly improve financial technology services to strengthen agriculture and benefit farmers, support and guide the development of private economy and farmers' multi-channel employment transfer, and maintain social stability.
Third, efforts should be made to solve people's livelihood problems.
Adhering to the people-oriented principle and promoting the solution of people's livelihood issues is another focus of the work of the Standing Committee. In our work, we pay attention to the combination of legislation and supervision. While promoting improvement, we should pay attention to formulating and perfecting laws. While strengthening legislation, we should pay attention to strengthening law enforcement inspection and work supervision to make NPC's work closer to people's livelihood and more effective.
Food safety is related to people's health and life safety, and is highly concerned by NPC representatives and all walks of life. In view of the outstanding problems exposed by major food safety incidents such as "Sanlu milk powder problem", the Standing Committee further revised the draft food safety law on the basis of in-depth investigation and extensive consultation. First, in order to effectively strengthen food safety supervision, on the basis of establishing the supervision of relevant competent departments according to their respective responsibilities, the State Council established the Food Safety Committee to coordinate and guide food safety work; At the same time, it is stipulated that local people's governments at or above the county level shall be responsible for, lead, organize and coordinate food safety supervision and management within their respective administrative areas. Second, in order to solve the problem of abuse of additives in food production, based on the principle of not using, using with caution and using less, it is clearly stipulated that only food additives that are technically necessary and proved safe and reliable by risk assessment are allowed to be used; If it is really necessary to use food additives, the varieties, scope and dosage specified in food safety standards must be strictly implemented; Do not use chemicals other than food additives or other substances that may endanger human health. Third, at present, the annual sales of all kinds of health care products in society exceed 654.38+000 billion yuan, but the supervision is not in place, and it is difficult to tell whether the products are true or false, and the people are at a loss. In order to solve this problem, the State Council is explicitly required to study and formulate relevant laws and regulations, standardize production activities, rectify the sales market, strengthen supervision and management, and reassure consumers.
On the basis of previous work, last year, the Standing Committee conducted a new round of law enforcement inspection on the revised Compulsory Education Law and the Law on the Protection of Minors, and conducted a law enforcement inspection on the newly promulgated and implemented Labor Contract Law. These three law enforcement inspections are directly related to the healthy growth of 65.438+0.7 billion primary and secondary school students, 360 million minors and the vital interests of hundreds of millions of workers. The issues involved are all issues that NPC deputies and the people are generally concerned about. Go deep into the reality and the grassroots, find out the outstanding problems in the implementation of the law, and put forward some important suggestions, such as implementing the guarantee mechanism of compulsory education funds, increasing the investment in compulsory education, purifying the network cultural environment of minors, and paying attention to solving the wage arrears of employees, especially migrant workers. The State Council and relevant departments have carefully studied our opinions and suggestions, so that the law can be better implemented and the work can be further improved. First, the guarantee mechanism for compulsory education funds was implemented according to law, and the funds for compulsory education increased substantially. Public expenditure in the budget for primary and junior high school students nationwide has increased substantially year-on-year, and the central government has also raised the funding standard for school building maintenance and renovation in the central and western regions. Second, the relevant departments of the State Council jointly launched a special campaign to rectify the vulgarity of the Internet, strengthen Internet management, and severely crack down on illegal and criminal acts that poison young people. The online cultural environment has improved, and it has been well received by all walks of life. Third, since the promulgation and implementation of the Labor Contract Law, the awareness of labor contracts in the whole society has generally improved, and the signing rate of labor contracts has greatly increased. The signing rate of labor contracts for enterprises above designated size reached 93%, the average term of newly signed labor contracts was extended, employment and re-employment were further strengthened, and the protection of the rights and interests of enterprise employees, especially migrant workers, was strengthened. In view of the new situation and problems faced by labor and employment, members of the Standing Committee pointed out during deliberation that it is necessary to vigorously support the development, transformation and upgrading of small and medium-sized enterprises, do everything possible to stabilize and expand employment, prevent wage arrears and mass layoffs, focus on solving the problem of low labor contract signing rate in service industry, construction industry, small and medium-sized enterprises and private enterprises, earnestly safeguard the legitimate rights and interests of workers, and strive to build harmonious labor relations.
In order to improve the social insurance system and relieve the worries of employees, on the basis of the last preliminary examination, the Standing Committee has made great changes to the draft social insurance law, making specific provisions on five kinds of insurance, such as pension, medical care, work injury, unemployment and maternity, and clearly defining the issues that employees are most concerned about. Such as transferring and continuing the basic old-age insurance relationship, improving the overall level of basic old-age insurance funds, and strengthening the supervision of social insurance funds, have aroused widespread social repercussions and are being revised and improved according to opinions from all sides. The Standing Committee also revised the Law on the Protection of Disabled Persons, enriched the provisions prohibiting discrimination against disabled persons, and strengthened the protection of the rights of disabled persons in rehabilitation, education, employment, social security and barrier-free environment construction.
