What conditions must be met to apply for a patent?

Kit Intellectual Property: What conditions must be met to apply for a patent?

To obtain a patent, many conditions must be met, and it is impossible to compile a detailed and universally applicable list. However, some key conditions include:

1. The invention must show novelty; That is to say, some new features are unknown in the existing knowledge in its technical field. This prior knowledge is called "prior art".

2. The invention must involve "creative steps" or "non-obviousness", that is, it cannot be obviously inferred by ordinary technicians in related technical fields.

3. The invention must be able to be applied to industry, which means it must be able to be used for industrial or commercial purposes, or be useful except for purely theoretical phenomena.

The law must admit that its theme is "patent". In many countries/regions, scientific theories, aesthetic creations, mathematical methods, animal and plant species, discovery of natural substances, business methods, medical methods (as opposed to medical products) or computer programs have not been patented.

5. The invention must be disclosed in the application in a clear and complete way, so that ordinary technicians in related technical fields can copy it.
