For a normal occupation, after seeing this kind of infringement, I believe many enterprises will take up legal weapons to safeguard their rights and interests, take these imitation enterprises to court, and then let them bear huge compensation. But strangely, there are so many fake Nike in China market, but no one is sued by Nike. Many netizens don't understand why Nike doesn't sue these infringements. It's not that Nike doesn't want to sue, but that they are willing but unable to do so. There are several main reasons.
First, it is difficult to find real counterfeiters. At present, many shoe factories in China are making fake Nike, including those in Putian, Quanzhou and other parts of the country. Moreover, when these manufacturers fake Nike, it is impossible to make a blatant fake, and many of them are secretly carried out, even without a formal subject. So even if Nike wants to sue, it may not be able to find a real fake manufacturer, and even if you find a manufacturer, its actual subject may be individual industrial and commercial households, and it is also a big deal to file for bankruptcy after being sued.
Second, there are many counterfeiters and they will never be prosecuted. How many manufacturers are making fake Nike at present? No one can give an accurate data, but I think there must be no fewer than thousands of manufacturers who make fakes. Fourth, these counterfeiters pose little threat to Nike. I think the fundamental reason why Nike doesn't sue these counterfeiters is that these manufacturers are not too big a threat to Nike. Although there are some fake Nike in Putian at present, they are no different from the real Nike, and even the quality may be better than the real Nike. But for those rich people, they would rather spend more money on genuine Nike than spend two or three hundred dollars on fake Nike, even if the fake Nike is of better quality. More people wear fake Nike, which gives Nike free publicity. Therefore, based on the above factors, Nike doesn't want to sue these fake manufacturers, even if it does, it won't have much effect, so it can only be allowed to do so. Of course, for some enterprises, if they blatantly produce fake Nike or adopt the same design of Nike, and then sell these shoes to the international market, they are likely to be sued by Nike.
For example, in February, 2065438+2009, Nike sued China manufacturer brand "Wanmi" in the Federal District Court for the Northern District of Illinois, on the grounds that "Wanmi promoted and sold sports shoes products with almost the same design as Nike's patent by providing its own sports shoes design, without fair competition". In short, whether Nike is willing to sue these counterfeiters depends on whether these manufacturers have touched Nike's vital interests. If there is no great threat to Nike's interests, there is no need for Nike to entangle with them.
