(1) Application fee, application surcharge and publication printing fee;
(2) Examination fee and reexamination fee for an application for a patent for invention;
(3) Patent registration fee, announcement printing fee, application maintenance fee and annual fee;
(four) the fee for changing the description, the fee for priority claim, the fee for restoring the right claim, the fee for requesting the extension of the time limit, and the fee for searching the report on the patent for utility model;
(five) the request for invalidation, the request for suspension of the procedure, the request for compulsory license and the request for compulsory license ruling.
The payment standards of the fees listed in the preceding paragraph shall be stipulated by the price management department of the State Council in conjunction with the patent administration department of the State Council.
The patent application fee is paid as follows:
1, the way to pay the application fee
The application fee and other fees can be paid directly to the Patent Office or its agency, or remitted through the bank or post office. Where remittance is made through a bank or post office, a payment slip shall be affixed to the remittance voucher or the postscript column in the fourth part of the remittance voucher, and the patent application number, the name of the applicant or patentee, the name of the fee (application fee) and the name of the invention-creation shall be indicated. If the bank adopts electronic remittance (satellite transmission), it shall require the bank to indicate the application number and the abbreviation of the fee name in the fee purpose column, such as "Shen" indicating the application fee (see the annex for the abbreviation of the fee name). But this requirement requires banks to charge special fees for sending and receiving telegrams. No matter how the applicant pays the fee, if the application number and fee name are not specified, or the writing is wrong, it will be deemed that the payment procedures have not been handled.
It's time to pay the application fee
Those who submit application documents to the Patent Office or its agency may pay the application fee on the spot after receiving the notification of acceptance. If the application documents are mailed to the Patent Office, the application fee shall be paid after receiving the notification of acceptance from the Patent Office. However, the payment date of the application fee shall not exceed two months from the date of application at the latest. Generally, the notification of acceptance from the Patent Office can be delivered to the applicant within one month after the applicant sends the application documents, so the general applicant has enough time to pay the application fee.

Article 75 Any of the following circumstances shall not be regarded as infringement of the patent right:
(1) The patentee or a unit or individual licensed by the patentee uses, promises to sell, sells or imports its patented products or products directly obtained by patented methods;
(2) Having manufactured the same product, used the same method or made necessary preparations for its manufacture and use before the patent application date, and continuing to manufacture and use it only within the original scope;
(3) Foreign means of transport temporarily passing through China's territorial waters and airspace use the relevant patents in their devices and equipment for their own needs in accordance with the agreements signed between their countries and China or international treaties to which they are both parties, or on the principle of reciprocity;
(four) the use of relevant patents for scientific research and experiments;
(5) manufacturing, using or importing patented drugs or patented medical devices for the purpose of providing information required for administrative examination and approval, or manufacturing or importing patented drugs or patented medical devices exclusively for them.
