To change the patentee, the patentee can be changed through the procedure of changing the description item. First, fill in the Declaration Form for the Change of Filing Matters, and at the same time provide the certification materials for the change of filing matters. If the applicant or patentee transfers his rights due to a dispute over the ownership of his rights, and the inventor changes his rights due to a dispute over his qualifications, and the dispute is resolved through consultation, it shall be an agreement on the transfer of rights signed or sealed by all parties; If the dispute is determined by a judgment of the people's court, it shall be submitted to a legally effective judgment of the people's court. 2. Where the patent applicant or patentee requests to change the patent applicant or patentee because of the right transfer or gift, the original or notarized copy of the transfer or gift contract must be submitted. 3. If the applicant or the patentee is a legal person, the change of the project description caused by its merger, reorganization, division, revocation, bankruptcy or restructuring must produce a legally binding document. 4. If the applicant or the patentee inherits due to death, it shall submit the certificate issued by the notary office that the relevant party is the only legal heir or that the relevant party has included all legal heirs. Legal basis:
Article 12 of the Measures for Filing Patent License Contracts. If the filing application passes the examination, China National Intellectual Property Administration will issue a Certificate of Filing the Patent License Contract to the parties concerned. If the filing application is under any of the following circumstances, it shall not be filed, and a notice of not filing the patent licensing contract shall be issued to the parties concerned: (1) The patent right has been terminated or declared invalid; (2) The licensor is not the patentee registered in the patent register or any other obligee who has the right to grant a license; (3) The patent licensing contract does not conform to the provisions of Article 9 of these Measures; (four) the license period exceeds the validity period of the patent right; (5) The patentee has entered into a patent licensing contract in violation of legal provisions or agreements; (6) The patent right is in the late payment period of the annual fee; (seven) due to disputes over the ownership of the patent right or the people's court ruling to take preservation measures for the patent right, the relevant procedures for the patent right are suspended; (8) Repeated application for filing of the same patent licensing contract; (nine) the patent right is pledged, except with the consent of the pledgee; (10) Conflicting with the registered patent licensing contract; (eleven) other circumstances that should not be filed.
