How do law firms apply for practice licenses?
According to the relevant laws and regulations of our country, the conditions that a law firm needs to meet when applying for a patent agency license include having an independent business place and having more than two partners.
Measures for the administration of patent agency
Article 12 To apply for a practice license, a law firm shall meet the following conditions:
(1) Having an independent business place;
(2) There are two or more partners or full-time lawyers who have obtained the patent agent qualification certificate.
Certification materials to be submitted when the patent agency changes.
1. The following certification materials shall be submitted for the change of the name of a patent agency:
(1) 1. Pre-approve the name to China National Intellectual Property Administration;
(2) An application for changing the specification item in duplicate, and stamped with the official seal of the changed patent agency;
(3) A copy of the changed business license of enterprise legal person (partnership business license);
(4) The original articles of association or partnership agreement of the patent agency;
(5) The original and photocopy of the patent agency registration certificate.
2, the patent agency address change shall submit the following documents:
(1) application form for project change filing in duplicate;
(2) A copy of the certificate of office space (house lease contract or house purchase certificate) or the changed business license of enterprise legal person (partnership business license);
(3) The original and photocopy of the patent agency registration certificate.
3. Where a limited liability patent agency changes its shareholders, it shall submit the following certification materials:
(1) application form for project change filing in duplicate;
(2) The original equity transfer agreement or stock withdrawal agreement;
(3) The original resolution of the shareholders' meeting;
(4) The original amendment to the articles of association of the patent agency;
(5) A copy of the patent agent qualification certificate and ID card of the new shareholder;
(6) a copy of the resume and personnel file keeping certificate and retirement certificate;
(7) If the shareholders of the original patent agency withdraw their shares, they shall provide the dismissal certificate of the original patent agency and the original equity transfer agreement or withdrawal agreement;
(8) A copy of the registration certificate of the patent agency.
4. Where a partnership patent agency changes its partners, it shall submit the following certification materials:
(1) application form for project change filing in duplicate;
(2) The original investment transfer agreement or withdrawal agreement;
(3) The original amendment to the partnership agreement;
(4) A copy of the patent agent qualification certificate and ID card of the new partner;
(5) a copy of the resume and personnel file keeping certificate and retirement certificate;
(6) If the partner of the original patent agency withdraws, it is required to provide the dismissal certificate of the original patent agency and the original investment transfer agreement or withdrawal agreement;
(7) A copy of the registration certificate of the patent agency.
