An appeal against the examiner's refusal decision may be filed with the JPO within three months (four months for overseas residents) from the date of sending a certified copy of the examiner's refusal decision.

If the Board of Appeal's review cancels the examiner's rejection decision, a decision to grant the patent will be transmitted. After paying the specified patent fee within the specified period, the patent right can be obtained.
