JIT Intellectual Property: What should you do when you receive the final decision from the Japan Patent Office (rejection of patent application)?
An appeal against the examiner's refusal decision may be filed with the JPO within three months (four months for overseas residents) from the date of sending a certified copy of the examiner's refusal decision.
If the Board of Appeal's review cancels the examiner's rejection decision, a decision to grant the patent will be transmitted. After paying the specified patent fee within the specified period, the patent right can be obtained.
