The first paragraph of Article 29 of the Provisions of the People's Court on the Attachment, Seizure and Freezing of Property in Civil Execution of the People's Court stipulates the time limit for the preservation of three types of property. The longest period of the first category is to freeze bank deposits and other funds for six months, the second category is to seal up and detain movable property 1 year, and the third category is to seal up and freeze real estate and other property rights for two years. There is no clear stipulation on the time limit for preserving the due creditor's rights, nor does it clearly state which of the above three categories should be included in preserving the due creditor's rights. Because the ruling of property preservation has legal effect from the time when it is made by the people's court, the time limit for property preservation should be specified.
Legal basis: Provisions of the Supreme People's Court Municipality on the Attachment, Seizure and Freezing of Property in Civil Execution by People's Courts Article 29 The time limit for people's courts to freeze bank deposits and other funds of the person subjected to execution shall not exceed six months, the time limit for attachment and seizure of movable property shall not exceed one year, and the time limit for attachment, seizure of real estate and freezing of other property rights shall not exceed two years. Except as otherwise provided by laws and judicial interpretations.
If the person subjected to execution applies for an extension of the time limit, the people's court shall go through the formalities of sealing up, distraining and freezing before the expiration of the time limit for sealing up, distraining and freezing, and the extension period shall not exceed half of the time limit specified in the preceding paragraph.
