Shenzhen Intellectual Property Protection Regulations for the 26th Summer Universiade (2020 Revision)

Article 1 In order to strengthen the protection of the intellectual property rights of the 26th Shenzhen Summer Universiade (hereinafter referred to as the Shenzhen Universiade), safeguard the legitimate rights and interests of the intellectual property rights holders of the Shenzhen Universiade, and protect and promote the enjoyment of university sports For sustainable and healthy development, these regulations are formulated in accordance with relevant laws and regulations. Article 2 These regulations shall apply to the management, protection and other activities related to the intellectual property rights of the Shenzhen Universiade in Shenzhen City; if there are other provisions for the protection of the special signs of the Shenzhen Universiade, those provisions shall prevail. Article 3 The intellectual property rights of the Shenzhen Universiade as referred to in these regulations refer to the exclusive rights enjoyed by the trademarks, patents, works, special signs, business secrets and other creative achievements related to the Shenzhen Universiade. Article 4 The trademarks, patents, works, special signs, trade secrets and other creative achievements related to the Shenzhen Universiade as mentioned in these regulations refer to:

(1) International University Sports Federation (hereinafter referred to as the International University Sports Federation) (2) China The name, emblem and logo of the University Sports Association of China (hereinafter referred to as the China University Sports Association);

(3) The Shenzhen Universiade Bidding Committee and the Organizing Committee (hereinafter referred to as the Organizing Committee) shall, on their own initiative during the period of bidding and hosting the Shenzhen Universiade, Or entrust others to develop emblems, mascots, names, logos, anthems, and slogans for their own use;

(4) Artistic performances, film and television works and other creations organized by the Shenzhen Universiade Organizing Committee Achievements;

(5) Patented products involving the Shenzhen Universiade logo;

(6) Design of special items such as trophies and medals for the Shenzhen Universiade. Article 5 The intellectual property rights holders of the Shenzhen Universiade refer to the International University Sports Federation, the China University Sports Association, the Shenzhen Universiade Organizing Committee, legally authorized licensees and other legal rights holders. Article 6 The protection of intellectual property rights in the Shenzhen Universiade shall follow the principles of safeguarding the dignity of college students’ sports, and ensuring that exclusive rights are not infringed, protected in accordance with the law, and used legally.

No organization or individual may infringe the intellectual property rights of the Shenzhen Universiade. Article 7 The Shenzhen Universiade Organizing Committee shall formulate a work plan for the protection of intellectual property rights of the Shenzhen Universiade, and promptly take the following measures to protect the intellectual property rights of the Shenzhen Universiade in accordance with the law:

(1) Apply for trademark registration;

(2) Apply for registration of special marks;

(3) Apply for patents;

(4) Register relevant works in a timely manner;

(5) Take action on trade secrets Confidentiality measures;

(6) Apply for customs filing of intellectual property rights. Article 8 The use of intellectual property rights in the Shenzhen Universiade should contribute to the healthy development of college student sports.

Any use of the intellectual property rights of the Shenzhen Universiade in Items 1, 3, 4, 5 and 6 of Article 4 of these Regulations shall be approved by the Shenzhen Universiade Organizing Committee, the International University Sports Federation or Permission from its authorized institution; any use of the intellectual property rights of the Shenzhen Universiade in Paragraph 2 of Article 4 of these Regulations shall be subject to permission from the China University Sports Association.

The Shenzhen Universiade Organizing Committee should issue a plan for the use of intellectual property rights of the Shenzhen Universiade, and authorize Shenzhen Universiade partners and Shenzhen Universiade merchandise franchisees to use the Shenzhen Universiade intellectual property rights as required.

Article 9 prohibits the following acts that infringe upon the intellectual property rights of the Shenzhen Universiade:

(1) Using the same or similar registered trademark of the Universiade on the same kind of goods or services or similar goods or services without permission;

(2) Selling goods that infringe the exclusive rights of the registered trademark of the Universiade;

(3) Forging or manufacturing the same or similar Universiade trademark logo without authorization or selling forged or manufacturing the Universiade trademark logo without authorization;

(4) Implementing Universiade patents without permission;

(5) Using Universiade patent numbers on products, product packaging, advertisements or other promotional materials without permission;

(6) Use Universiade works or other creative achievements without permission, except as otherwise provided by laws and regulations;

(7) Provide venues, warehouses, and Convenient conditions for transportation, mailing, concealment, etc.;

(8) Other infringements that violate relevant laws and regulations. Article 10 Advertisers, advertising operators, and advertising publishers shall not infringe the intellectual property rights of the Shenzhen Universiade during advertising design, production, agency, and publishing activities.

Advertising operators and advertising publishers should strengthen review and strictly verify certification documents during advertising activities. Article 11 The market supervision department shall assist the Shenzhen Universiade Organizing Committee in the registration of intellectual property rights, effectively perform its duties, and strengthen law enforcement and inspection work to protect the intellectual property rights of the Shenzhen Universiade. Article 12 Illegal acts that infringe upon the trademark rights, patent rights, copyrights, exclusive rights of special signs and trade secrets of the Shenzhen Universiade shall be investigated and dealt with by the market supervision department in accordance with the law.

Administrative law enforcement departments such as public security, urban management and comprehensive law enforcement should do a good job in protecting the intellectual property rights of the Shenzhen Universiade in accordance with their respective responsibilities. Article 13 When investigating and handling illegal acts that infringe on the intellectual property rights of the Shenzhen Universiade, the market supervision department may exercise the following powers:

(1) Question the parties, interested parties and witnesses;

( 2) Review and copy files, contracts, drawings, account books and other materials related to the case;

(3) Conduct on-site inspections by inspection, photography, video recording, measurement, etc.;

(4) Register and preserve items related to the case as evidence in accordance with the law;

(5) Investigate other circumstances related to the case;

(6) As stipulated by laws and regulations Other powers.

When investigating and punishing illegal acts that infringe on the intellectual property rights of the Shenzhen Universiade, the market supervision department, in addition to exercising the powers listed in the preceding paragraph, may seal up or detain items that are proven to infringe the trademark rights of the Shenzhen Universiade in accordance with the law.
