The court recognizes electronic evidence. The second paragraph of Article 1 1 of the Regulations clearly stipulates that the electronic data submitted by the parties can be obtained, fixed and tamper-proof by technical means such as electronic signature, trusted timestamp, hash value verification and blockchain, or authenticated by the electronic evidence collection and storage platform, and it is proved to be true, and the Internet court shall confirm it. This is the first time that China has legally confirmed electronic signature, trusted timestamp, hash value verification and blockchain in the form of judicial interpretation, which means that the authenticity and validity of electronic data can be confirmed. Second, improve the proof method of electronic data evidence. Article 9 of the Regulations stipulates that the parties shall upload online electronic data into the litigation platform, or upload offline evidence to the litigation platform for proof by scanning, copying and transcription, or use the electronic data that has been imported into the litigation platform to prove their claims. The specific ways of submitting electronic data evidence are clarified, that is, uploading, scanning, remaking, transcription and other ways to electronically process and provide evidence. Micro-copyright forensics technology has the invention patent certificate issued by China National Intellectual Property Administration, and jointly developed "Forensic Protection V2.0" with the notary office. When users obtain evidence through the Internet, the system will automatically obtain the current standard time and record relevant information on the blockchain to ensure the integrity and authenticity of the data and make the chain of rights protection evidence more complete. At present, the micro-copyright forensics technology and deposit certificate have been recognized by the judiciary, and accepted by officials of Beijing Internet Court, Beijing Intellectual Property Court, Inner Mongolia High Court, Shaanxi High Court, Wuxi Intermediate People's Court, etc., to help original enterprises and individual users successfully defend their rights.
