The specific contents of the patent agent examination:
The examination is held once a year, and the national unified proposition is implemented. The scope of the proposition is subject to the examination outline. The exam includes the following subjects:
(a) patent legal knowledge:
(2) Relevant legal knowledge;
(3) Patent agency practice.
The part of patent legal knowledge includes an overview of patent system, substantive conditions for granting patent right, requirements for patent application documents, procedures and steps for applying for patent right, application and examination process of patent, reexamination of patent application and invalidation of patent right, implementation and protection of patent right, patent cooperation treaty and other international treaties related to patent, patent documents and patent classification (Chapter 4.
Laws and regulations involved: Patent Law of People's Republic of China (PRC), Detailed Rules for the Implementation of Patent Law of People's Republic of China (PRC), Guide to Patent Examination, Measures for the Administration of Patent Agency, Patent Cooperation Treaty, International Classification of Designs, Budapest Treaty and Measures for Priority Examination.
The examination is a closed-book examination and adopts computerized examination method.
The examination shall be marked uniformly throughout the country, and the organization and coordination of marking shall be undertaken by the Office of the Examination Committee. Candidates after three years.
If all subjects pass the examination, China National Intellectual Property Administration will issue a patent agent qualification certificate after the examination.
