However, I recently found a notice issued by an intellectual property office. I wonder if this behavior is really formulated for this problem. Is it abnormal application behavior?
The Regulations on Regulating the Behavior of Patent Application promulgated by China National Intellectual Property Administration (hereinafter referred to as the Regulations) has been implemented since June, 2007 10.
The "Regulations" require that those who submit or submit patent applications on their behalf shall abide by the relevant provisions of laws, regulations and rules, abide by the principle of good faith, and shall not engage in abnormal patent application activities. In China National Intellectual Property Administration, in addition to handling submitted patent applications in accordance with the provisions of the Patent Law and its detailed rules for implementation, measures can also be taken according to the situation, and before taking measures, the parties concerned should be given the opportunity to state their opinions.
The regulations require that the patent administrative department of the local people's government should guide the public and patent agencies to submit patent applications according to law. If a patent agency finds that the patent application is abnormal, it shall report to China National Intellectual Property Administration in time. If the circumstances are serious enough to constitute a crime, they shall be transferred to the relevant authorities for criminal responsibility.
It is suggested that the All-China Patent Agents Association take industry self-discipline measures against patent agencies and patent agents engaged in abnormal patent applications, and if necessary, it is suggested that the Patent Agents Disciplinary Committee give corresponding punishment according to the provisions of the Disciplinary Rules for Patent Agents (Provisional).
The "Regulations" clearly point out that an abnormal patent application refers to the fact that the same unit or individual submits multiple patent applications with obviously the same content, or instructs others to submit multiple patent applications with obviously the same content; The same unit or individual submits patent applications that obviously plagiarize existing technologies or designs for many times, or instructs others to submit patent applications that obviously plagiarize existing technologies or designs for many times. If the patent agency submits the above-mentioned type of application, it is also an abnormal patent application.
