China National Intellectual Property Administration recently promulgated the Measures for the Administration of Patent Priority Examination, which came into effect on August 6, 2004. The new "Measures" expand the scope of application of priority review, covering the patent applications for inventions, utility models and designs in the substantive review stage, as well as the review of these three patent applications and three patent invalidation cases; Improve the applicable conditions of priority review, expand and enrich the applicable scope of priority review; Further simplify the procedure of priority review; Optimize the processing procedure of priority review, and stipulate that the specific circumstances that need to stop the priority review procedure for some reason shall be handled as a general application.
The "Measures" stipulate that a patent application or patent re-examination case under any of the following circumstances may request priority review: it involves energy conservation and environmental protection, next-generation information technology, biology, high-end equipment manufacturing, new energy, new materials, new energy vehicles, intelligent manufacturing and other national key development industries; Industries encouraged by the people's governments of provinces and districts; Involved in the fields of internet, big data, cloud computing, etc., industries with fast technology or product updates.
