Who is the first applicant for the patent?

Article 9 of the Patent Law stipulates that "where two or more applicants apply for a patent for the same invention-creation, the patent right shall be granted to the person who applied first." Where a patent is filed on different dates, the first applicant shall be judged in the order of filing date. For applications filed on the same day, the detailed rules for the implementation of the Patent Law also stipulate that "where two or more applicants apply for a patent for the same invention-creation on the same day, they shall, after receiving the notice from the Patent Office, determine the person who has the right to file the application through consultation." The patent office only grants patent rights to those determined through consultation. If the negotiation opinions are inconsistent, or one party refuses to negotiate, the Patent Office will not grant the patent right to both parties. Generally speaking, two or more applicants jointly apply for a patent. After the application is approved, the patent right belongs to them. Or a person applies for and obtains a patent right, and he gives other applicants necessary compensation and preferential treatment.
