Interim Measures of the State Administration for Industry and Commerce on Archives Management of Individual Industrial and Commercial Households

Chapter I General Provisions Article 1 In order to give full play to the role of archives in the management of individual industrial and commercial households and promote the healthy development of individual industrial and commercial households, these Measures are formulated in accordance with the relevant provisions of the Archives Law of People's Republic of China (PRC) and the Provisional Regulations on the Management of Urban and Rural Individual Industrial and Commercial Households. Article 2 The archives of individual industrial and commercial households are all kinds of documents, vouchers, photos, audio-visual and other historical records with reference value directly formed by the administrative department for industry and commerce in the registration, supervision and management of individual industrial and commercial households, and are an important basis for the administrative department for industry and commerce to supervise and manage individual industrial and commercial households. Article 3 The administrative departments for industry and commerce at all levels shall manage the archives of individual industrial and commercial households in accordance with these Measures, and accept the professional supervision and guidance of the national archives management department at the same level. Chapter II Establishment of Archives Article 4 The county-level administrative department for industry and commerce must establish archives of individual industrial and commercial households, and set up archives rooms and archives storage counters. Archives should be equipped with full-time management personnel. Article 5 The archives of individual industrial and commercial households shall be filed by households, with one file for each household. Article 6 The archives of individual industrial and commercial households consist of registration materials, daily supervision and management materials and other relevant materials.

Registration information includes:

(1) Business registration materials. Refers to the application form, the application registration form, the identity and qualification certificate of employees, the certificate of use of business premises, and the approval documents of relevant departments.

(2) Changing the registration materials. Refers to the application for change of registration form, the recovered business license and its copy and other related materials.

(3) Business suspension or business suspension registration materials. Refers to the application for suspension of business, the report of suspension of business, the business license recovered after the application for suspension of business and its copy and other related materials.

Daily supervision and management information includes:

(a) All materials formed during inspection and replacement.

(2) Relevant materials such as suspension of business for rectification, cancellation and revocation of business license.

(3) Advanced deeds and awards.

(4) The qualifications of deputies to the Party Congress, the National People's Congress, members of the CPPCC and members of social organizations at or above the county level.

(5) Records on the decision and implementation of illegal acts. Article 7 In the process of registration and daily supervision and management of individual industrial and commercial households, all relevant business departments within the administrative department for industry and commerce shall timely and completely hand over relevant materials to the archives of the county-level administrative department for industry and commerce at the place where the license is issued. Eighth archives management personnel to receive files, to check the contents of the file, to meet the requirements of receiving, and handle the file transfer procedures. Article 9 Archivists shall, after receiving the archives, arrange the filing order according to the industries, distribution areas, organizational forms, opening years and other items engaged by individual industrial and commercial households, and fill in the retrieval card and the archives directory register.

In every family file, there should be a list of documents, materials and certificates received.

The files of temporary business households should be stored and numbered separately. Chapter III Utilization of Archives Article 10 Archivists shall strictly implement the confidentiality system. Except for public security organs, people's courts, people's procuratorates and relevant state organs, other units and individuals are generally prohibited from borrowing and consulting files. If it is necessary to consult the archives due to special circumstances, it shall be reported to the county-level administrative department for industry and commerce for approval.

When borrowing files, you should abide by the file borrowing system. Eleventh violation of the file lending system, unauthorized modification, marking, copying, lending, copying, transferring, destroying the contents of the file, should be held accountable. Twelfth relevant units need to inquire about the archives of individual industrial and commercial households, to hold a letter of introduction.

Fees shall be paid for inquiring files (except for public security, procuratorial, legal and industrial and commercial administrative departments). Chapter IV Archives Management Article 13 The archives of individual industrial and commercial households shall be properly kept. Files should have security facilities such as anti-theft, moisture-proof, insect-proof and fire prevention.

After individual industrial and commercial households are cancelled or their business licenses are revoked, they should regularly conduct safety inspections on their files, and it is strictly forbidden for individuals to destroy them without authorization. Article 14 The county-level administrative department for industry and commerce shall strictly abide by the file keeping system, file lending system and archivist's responsibility system when managing files. Fifteenth administrative departments for industry and commerce and archives management organs shall, in accordance with the national archives law and relevant regulations, determine the types and dates of the files to be handed over, and handle the handover procedures in time. Chapter V Duration of Archival Preservation Article 16 The duration of archival preservation can be divided into permanent, long-term and short-term from the date when individual industrial and commercial households cancel their registration and revoke their business licenses.

(1) Permanent files shall be kept for more than 50 years. Meet one of the following conditions, should be included in the permanent file.

1, an individual industrial and commercial household that produces famous, excellent and special products that are well-known in the country or internationally;

2. Individual industrial and commercial households that have won national and international invention awards or obtained patents;

3. Individual industrial and commercial households earning more than 500,000 yuan in foreign exchange annually;

4. Individual industrial and commercial households with a registered capital of more than 200,000 yuan or 50 times the registered capital of local households;

5, the annual turnover of more than 500 thousand yuan or more than 50 times the average annual turnover of local households;

6, the administrative department for Industry and commerce and the archives management organ that it is necessary to permanently save the file.

(2) The storage period of long-term archives is 16-50 years. Meet one of the following conditions, should be included in the long-term preservation of archives.

1, individual industrial and commercial households with a registered capital of more than 654.38+10,000 yuan or more than 20 times the registered capital of local households;

2. Individual industrial and commercial households with annual turnover or income exceeding 200,000 yuan for three consecutive years or reaching the average annual turnover of local families in the same industry of more than 30 times;

3. Representatives of Party congresses, people's congresses, CPPCC members and members of social organizations at or above the county level, or advanced figures commended by units at or above the county level for three consecutive years;

4, the administrative department for Industry and commerce and the archives management organ that should be preserved for a long time.

(3) Except for permanent and long-term archives, they are all short-term archives. The storage period of short-term files is 15 years.
