(1) The legal system of using the credit punishment mechanism to restrain and limit the subject of dishonesty is not perfect, and the joint punishment mechanism is insufficient. At present, China's personal credit system is not complete, and the basis for applying the personal credit blacklist system is only the opinions jointly issued by various departments, and it has not risen to the level of laws and regulations. However, the application of the personal credit blacklist system has had a serious impact on the rights of the counterpart, and it is obviously not enough to limit some rights of the parties only by the relevant provisions of the Opinions. The most important thing is that there is no perfect personal credit information system in China, so the punishment scope of personal credit blacklist can only be limited to the industry. For example, the counterpart who violates the Opinions on Restricting Civil Aviation is only restricted to take civil aviation flights within a certain period of time, but it is not prohibited to take trains or engage in other financing loans attached to personal credit. There is a serious lack of operability in punishment. At the same time, there is still no communication between the restrictions on flying and trains on the credit China, let alone with banks, financial institutions or other institutions, which directly leads to the lack of punishment.
(2) The scope of punishment for the subject of dishonesty is small. The existing personal credit blacklist system in China only includes the blacklist of some serious untrustworthy people in civil aviation, the blacklist of people who have been executed by the court and the blacklist of serious untrustworthy people in railway transportation enterprises. The scope of punishment includes not only Lao Lai who refuses to execute the effective judgment of the court, but also the relative person who is punished by public security management or investigated for criminal responsibility for serious illegal acts in the civil aviation field and railway transportation field. Individuals who make and sell fake goods in the field of food and drug safety, professional medical troubles and traffickers who deliberately disturb the normal medical order of hospitals are not among them, and the scope of punishment is relatively narrow. At present, it is difficult to achieve the goal of building a credit system for the whole society.
(3) The punishment for the subject of dishonesty is relatively simple. At present, in China's personal credit blacklist system, in addition to publicity and flight restrictions, there are also disciplinary measures such as restricting high consumption for the blacklisted counterpart in the system of untrustworthy executors. Other personal credit blacklist systems only include one or two items, such as restricting the counterpart from taking trains or civil aviation flights, publicity, etc., which can only last for one year or half a year. Moreover, the application of this system also requires the counterpart to be punished by public security or criminal punishment for its serious illegal acts. This problem directly leads to the failure of the personal credit blacklist system to deal with those who have seriously broken their promises but have not violated the Law on Public Security Administration Punishment. In terms of punishment, it is also difficult to distinguish between those who are seriously investigated for criminal responsibility for seriously endangering flight and railway safety and those who are given warnings or fines only for violating the Law on Public Security Administration Punishment, and it is difficult to achieve the purpose of punishing those who are seriously untrustworthy.
In short, if these problems are solved one by one, parents will be blacklisted, which will have a greater and greater impact on their children.
