Article 87 This crime will no longer be pursued after the following period:
(1) If the statutory maximum penalty is fixed-term imprisonment of not more than five years, five years later; (2) If the statutory maximum penalty is fixed-term imprisonment of not less than five years but not more than ten years, ten years later;
(3) If the statutory maximum penalty is fixed-term imprisonment of more than ten years, ten years later; (4) If the statutory maximum penalty is fixed-term imprisonment of less than ten years, the statutory maximum penalty shall be ten years later. If the term of imprisonment exceeds ten years, fifteen years shall expire;
(d) If the statutory maximum penalty is life imprisonment or death, if it is deemed necessary to prosecute after the expiration of twenty years. Submit to the Supreme People's Procuratorate for approval.
Article 88: Victims who evade investigation and trial after the People's Procuratorate, public security organs, and national security organs have filed a case for investigation or the People's Court has accepted the case shall not be subject to the time limit for prosecution. If a complaint is filed within the prosecution period and the people's court, people's procuratorate or public security organ should file a case but fails to do so, the prosecution period will not be restricted.
Article 89 The prosecution period shall be calculated from the date of the crime; If a person commits a continuous or continuing crime, the prosecution period shall be calculated from the date of the commission of the subsequent crime.
