(4) Having the status of a public official and being a public lawyer with the consent of the unit where he works;
(5) Having been engaged in legal affairs in this unit for more than two years, or having served as a judge, prosecutor or lawyer for more than one year;
(6) Good conduct.
2. Who can't apply for a public lawyer?
(1) Having no or limited capacity for civil conduct;
(2) The practicing certificates of lawyers and notaries have been revoked;
(three) suspected of committing a crime, the judicial process has not yet ended, or suspected of violating the law and discipline, and is under review;
(four) the results of the annual assessment of civil servants in the previous year were determined to be incompetent;
(five) is being listed as the object of joint punishment;
(six) other unsuitable for public lawyers.
3. What materials should I submit to apply for a public lawyer?
(1) An application form for a public lawyer;
(2) The original and photocopy of the legal professional qualification certificate or lawyer qualification certificate;
(3) Certification materials that have been trained and passed the examination by the Provincial Department of Justice and the Provincial Lawyers Association;
(4) Original and photocopy of ID card;
(five) a copy of the civil service registration form;
(6) The certificate issued by the applicant's unit, including: the applicant is an on-the-job civil servant of the unit, the applicant has been engaged in legal affairs for more than two years, and has agreed to be a public lawyer, and there is no violation of laws and regulations;
(seven) a copy of the applicant's employment documents in the unit or the certificate and letter of appointment of the legal adviser of the unit.
4. What legal affairs can public lawyers engage in?
(a) to provide legal advice for the unit to discuss and decide on major issues;
(two) to participate in the drafting and demonstration of draft laws and regulations, draft internal party regulations and normative documents;
(three) to participate in the negotiation of cooperative projects, foreign bidding, government procurement and other affairs, and to draft, modify and review important legal documents or contracts and agreements;
(four) to participate in the reception of letters and visits, the mediation of contradictions, the resolution of cases involving law and litigation, the handling of emergencies, the disclosure of government information, and state compensation;
(five) to participate in administrative punishment reconsideration, administrative adjudication, administrative reconsideration, administrative litigation and other work;
(six) to implement the responsibility system of "whoever enforces the law and popularizes the law" and carry out publicity and education on popularizing the law;
(seven) to handle civil litigation and mediation, arbitration and other legal affairs;
(eight) other legal affairs entrusted or assigned by the unit.

Article 5 of the People's Republic of China (PRC) Lawyers Law requires the following conditions to apply for the issuance of a public lawyer's certificate:
(1) support the constitution of People's Republic of China (PRC);
(2) Obtaining legal professional qualification or lawyer qualification according to law;
(3) Concluding labor contracts with state-owned enterprises according to law;
(four) engaged in legal affairs for more than two years, or served as a judge, prosecutor or lawyer for more than one year;
