An agent ad litem refers to a person who represents the principal in litigation activities according to the authorization of an agent.
Criminal litigation agent refers to the victim who accepts public prosecution cases and his legal representative or close relatives, and the private prosecutor and his legal representative who accepts private prosecution cases;
As well as the entrustment of the parties involved in civil litigation and their legal representatives, to participate in litigation and conduct activities in the name of the principal, and the principal shall bear the legal consequences of the agency behavior.
The main scope of litigation agency includes:

3. Guardian, relatives and friends of the victim.

In China, except for cases in which the parties are required by law to conduct litigation in person, victims in criminal proceedings, private prosecutors, plaintiffs, defendants and third parties in civil proceedings can all be represented by litigation agents.
Conduct litigation activities in the name of the client. The purpose of litigation agency is to safeguard the legitimate rights and interests of the principal, so litigation can only be carried out in the name of the principal, not in its own name. Neither party can represent the same lawsuit.
In litigation, the interests of both parties are opposite. Acting as an agent for both parties at the same time may harm the interests of one party.
A civil litigation agent refers to a person who carries out litigation activities in the name of the parties and within a certain scope of authority for the interests of the parties. Due to the different agency rights, it can be divided into legal agent ad litem and entrusted agent ad litem.

Article 33 of the Criminal Procedure Law
A criminal suspect or defendant may entrust one or two persons as defenders in addition to exercising the right of defense by himself. The following persons may be entrusted as defenders:
(1) lawyers;
(2) A person recommended by a people's organization or the unit to which the criminal suspect or defendant belongs;
(3) Guardians, relatives and friends of criminal suspects and defendants. A person who has been sentenced to punishment according to law or deprived of or restricted personal freedom shall not act as a defender.
A person who has been dismissed from public office or has his lawyer's or notary's practice certificate revoked may not act as a defender, except the guardian or near relative of the criminal suspect or defendant.
Article 47
Entrusting an agent ad litem shall be carried out with reference to the provisions of Article 33 of this Law.

Article 108 The meanings of the following terms in this Law are:
(1) "Investigation" refers to the work of public security organs and people's procuratorates to collect evidence and ascertain the facts of criminal cases and the relevant compulsory measures taken according to law;
(2) "Parties" refer to victims, private prosecutors, criminal suspects, defendants, plaintiffs and defendants in incidental civil actions;
(3) "Legal representative" refers to the parents, adoptive parents and guardians of the client and the representatives of the organs and organizations responsible for protection;
(4) "Participants in litigation" refers to the parties, legal representatives, agents ad litem, defenders, witnesses, expert witnesses and translators;
"Agent ad litem" refers to the victim of a public prosecution case and his legal representative or near relative, the person entrusted by the private prosecutor and his legal representative in a private prosecution case to participate in the litigation on his behalf, and the person entrusted by the party involved in an incidental civil litigation and his legal representative to participate in the litigation on his behalf;
(6) "Close relatives" refer to husbands, wives, fathers, mothers, sons, daughters, brothers and sisters.
