The Ministry of Justice and the judicial departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government have set up the Lawyers Qualification Examination Committee and the Lawyers Qualification Examination Group respectively, which are specifically responsible for the relevant work. Article 4 People's Republic of China (PRC) citizens who support the Constitution of People's Republic of China (PRC), have good conduct and good health, are under the age of 65, have a bachelor's degree in law in an institution of higher learning or above, and can engage in full-time lawyer work after obtaining the qualification as a lawyer. Those who meet one of the following conditions may apply for examination and be granted the qualification as a lawyer:
(a) engaged in legal education or research in higher law schools (departments) or legal research institutions, and obtained senior titles;
(two) with a master's degree in law or above, with more than three years of legal work experience or work in a law firm for more than one year;
(3) Other personnel with senior professional titles or equivalent professional level may be granted the qualification of lawyer. Article 5 A lawyer shall not be granted the qualification under any of the following circumstances:
(1) Having received criminal punishment, except for negligent crimes;
(2) Being expelled from public office or having his lawyer's practice license revoked;
(3) Having no or limited capacity for civil conduct;
(4) Forging the certification materials to apply for the examination and grant the qualification as a lawyer;
(5) Others who are not suitable for practicing as lawyers. Article 6 To apply for the lawyer qualification examination, the following materials shall be submitted:
(a) the lawyer qualification examination application form;
(two) opinions issued by the law firm where the applicant is located or intends to be transferred;
(3) the resume and identity card of the applicant;
(four) the applicant's academic certificate, degree certificate and professional and technical post certificate;
(five) other materials required by the assessment authority. Article 7 An applicant shall submit application materials to the judicial administrative organ of his domicile through the law firm where he works or intends to be transferred, and the judicial administrative organ of his domicile shall put forward examination opinions within 15 days and report them to the judicial departments (bureaus) of provinces, autonomous regions and municipalities directly under the Central Government step by step. Article 8 The judicial departments (bureaus) of provinces, autonomous regions and municipalities directly under the Central Government shall, within 60 days from the date of receiving the application materials, examine the applicant's legal professional knowledge, lawyer's professional ethics and practice discipline rules, put forward corresponding opinions and report them to the Ministry of Justice for examination and approval. Article 9 The Ministry of Justice conducts a unified examination of the application for granting lawyer qualification through examination twice a year, and makes a decision of approval or disapproval respectively, and notifies the judicial departments (bureaus) of provinces, autonomous regions and municipalities directly under the Central Government in writing. If the lawyer qualification is approved, a lawyer qualification certificate shall be issued at the same time. Article 10 After obtaining the qualification as a lawyer, an applicant shall apply for a lawyer's practice certificate and perform his duties as a lawyer in accordance with the prescribed procedures. Article 11 In any of the following circumstances, the Ministry of Justice shall, in accordance with the examination and approval procedures, revoke the decision to grant lawyer qualification and withdraw the lawyer qualification certificate;
(1) Forging or altering certification materials to deceive lawyers;
(2) Not working as a full-time lawyer. Twelfth Hong Kong and Macao residents lawyer qualification assessment and grant measures shall be formulated separately.
