1. Judges Article 10 of the Judges Law of People's Republic of China (PRC) shall not serve as judges: (1) Having received criminal punishment for crimes; (2) Being expelled from public office.
2. People's Jurors "Decision of the Standing Committee of the National People's Congress on Improving the People's Jury System" Article 6 The following persons shall not serve as people's jurors: (1) Those who have been criminally punished for crimes;
3. Procurators Article 11 of the Procurator Law of the People's Republic of China: (1) Having been criminally punished for committing a crime; (2) Being expelled from public office.
4. Civil Servants Article 24 of the People's Republic of China (PRC) Civil Servant Law The following persons shall not be employed as civil servants: (1) Those who have been criminally punished for crimes; (2) Being expelled from public office; (three) there are other circumstances in which the law stipulates that it is not allowed to be employed as a civil servant.
5. Lawyers Article 7 of the People's Republic of China (PRC) Lawyers Law An applicant shall not be issued a lawyer's practice certificate under any of the following circumstances: (1) No capacity for civil conduct or limited capacity for civil conduct; (2) Having been subjected to criminal punishment, except for negligent crimes; (3) Being expelled from public office or having his lawyer's practice certificate revoked.
Article 49 If a lawyer is subject to criminal punishment for intentional crime, the judicial administrative department of the people's government of a province, autonomous region or municipality directly under the Central Government shall revoke his lawyer's practice certificate.
6. Defender Article 32 of the Criminal Procedure Law of People's Republic of China (PRC) (as amended by 20 12) A person who has been sentenced to a criminal penalty according to law or deprived of or restricted his personal freedom may not act as a defender.
7. Decision of the National People's Congress Standing Committee (NPCSC) on the Administration of Judicial Expertise (revised 20 15).
Four, because of intentional crime or dereliction of duty, criminal punishment, dismissal from public office, as well as the cancellation of registration of the appraiser, shall not engage in judicial expertise.
8. Notary Article 20 of the Notary Law of People's Republic of China (PRC) (revised on 20 15) shall not be a notary under any of the following circumstances: (1) No capacity for civil conduct or limited capacity for civil conduct; (2) Having received criminal punishment for intentional crime or duty negligence crime; (3) Being expelled from public office; (4) The practice certificate has been revoked.
9. Police Article 26 of the People's Police Law of the People's Republic of China (revised 20 12) shall not serve as a people's police under any of the following circumstances: (1) Having been criminally punished for a crime; (2) Being expelled from public office.
10. Diplomatic personnel Article 7 of the Law of People's Republic of China (PRC) on Diplomatic Personnel Abroad shall not serve as diplomatic personnel abroad under any of the following circumstances: (1) Those who have been criminally punished for crimes.
1 1, members of villagers' committees "Organization Law of Villagers' Committees of the People's Republic of China" (revised on 20 10) Article 18 If a member of a villagers' committee loses his capacity or is sentenced to punishment, his post will automatically terminate.
12, auctioneer Article 15 An auctioneer shall meet the following conditions: (1) Having a college degree or above and having professional knowledge of auction; (2) Having worked in an auction enterprise for more than two years; (3) Good conduct. An auctioneer who has been dismissed from public office or whose qualification certificate has been revoked for less than five years, or who has been criminally punished for intentional crimes, shall not be an auctioneer.
13. Directors, supervisors and senior managers of the company Article 146 of the Company Law of People's Republic of China (PRC) shall not serve as directors, supervisors or senior managers of the company under any of the following circumstances: (2) Being sentenced to punishment for committing the crime of corruption, bribery, embezzlement of property, misappropriation of property or disrupting the order of the socialist market economy, and being deprived of political rights due to the crime,
14. Directors, supervisors and senior managers of wholly state-owned enterprises, wholly state-owned companies and state-owned capital holding companies Article 73 of the Law of People's Republic of China (PRC) on State-owned Assets of State-owned Enterprises, Wholly State-owned Companies and State-owned Capital Holding Companies. Directors, supervisors and senior managers of wholly state-owned enterprises, wholly state-owned companies and state-owned capital holding companies who are dismissed in violation of the provisions of this law shall not be allowed to serve as wholly state-owned enterprises for five years from the date of dismissal.
Those who have caused particularly heavy losses to state-owned assets, or who have been sentenced to punishment for corruption, bribery, embezzlement, misappropriation of property or disrupting the order of the socialist market economy, shall not serve as directors, supervisors or senior managers of wholly state-owned enterprises, wholly state-owned companies or state-owned capital holding companies for life.
15. Directors and senior managers of commercial banks Article 27 of the Law of People's Republic of China (PRC) Commercial Bank (revised on 20 15) shall not serve as directors or senior managers of commercial banks under any of the following circumstances: (1) Being sentenced to punishment for committing crimes of corruption, bribery, embezzlement of property, misappropriation of property or disrupting social and economic order.
Article 15 of the Securities Investment Fund Law of People's Republic of China (PRC) (revised 20 15) shall not serve as a director, supervisor, senior manager or other employees of the fund manager who publicly offers funds under any of the following circumstances: (1) Being guilty of corruption, bribery, dereliction of duty, property infringement or disrupting the order of the socialist market economy,
Article 108 of the Securities Law of People's Republic of China (PRC) (revised 20 14) shall not be the person in charge of a stock exchange under any of the circumstances specified in Article 146 of the Company Law of People's Republic of China (PRC): Article 131 No person shall be the person in charge of a securities company under any of the circumstances specified in Article 146 of the Company Law of People's Republic of China (PRC).
17. A director, supervisor or senior manager of an insurance company may not serve as a director, supervisor or senior manager of an insurance company under the circumstances specified in Article 82 of the Insurance Law of People's Republic of China (PRC) (revised on 20 15) or under any of the following circumstances:
(1) The directors, supervisors and senior managers of financial institutions who have been disqualified by financial supervision and regulation institutions due to illegal or disciplinary acts have not been more than five years since the date of disqualification; (2) Lawyers, certified public accountants or professionals such as asset appraisal institutions and verification institutions. It has not been more than five years since the practice qualification was revoked due to illegal acts.
18. Bankruptcy administrator Article 24 of the Enterprise Bankruptcy Law of the People's Republic of China shall not be an administrator under any of the following circumstances: (1) He has been criminally punished for intentional crimes.
19, legal representative and senior manager of seed enterprises Article 76 of the Seed Law of People's Republic of China (PRC) (revised on 20 15) If a person is sentenced to more than fixed-term imprisonment for the crime of producing and dealing in inferior seeds, the legal representative and the directly responsible person in charge of the seed enterprise or other units shall not be the legal representative or senior manager of the seed enterprise within five years from the date of execution of the punishment.
