The criminal prosecution of minors (hereinafter referred to as "not examined") is a special criminal prosecution which is different from adults according to the physical and mental characteristics of minors and related laws and regulations, and is an important part of the juvenile justice system. Fan, director of the unchecked department of the Shanghai Procuratorate, said: "Juvenile criminal cases should be handled by a special unchecked institution, just as a sick child is sent to a special children's hospital or pediatric clinic." It is understood that 1986, Shanghai established the first "juvenile prosecution group" in the national procuratorate to handle juvenile cases. 1992, the first independent criminal prosecution department for minors was established in Shanghai. 1996, all the grass-roots procuratorates in the city set up independent specialized agencies, without procuratorial work. After more than 20 years of exploration and development, there are currently 1 10 cadres specializing in non-prosecution in the criminal prosecution of minors in Shanghai procuratorate.
For more than 20 years, Shanghai procuratorial organs have created a set of procuratorial working mechanism that conforms to the characteristics of minors, adopted the case-handling mode of "integrating arrest, prosecution and prevention", and initiated the working mechanism and practical exploration of juvenile trial education, social investigation, family meeting, pre-litigation investigation, non-prosecution assistance, and suitable for adults to participate in litigation. Some practices have become legal norms and promoted the progress of juvenile justice system in China. These explorations and innovations have effectively protected the litigation rights and legitimate rights and interests of minors involved in crimes, severely cracked down on the acts of organizing, luring, coercing and abetting minors to commit crimes, and saved a large number of minors who escaped the net of education. According to statistics, in the past 20 years, nearly 60% of them have been saved through education, returned to school through various channels, found jobs, and become useful talents in society. For example, minors Yu and Huang robbed others of nearly 1,000 yuan. The Hongkou District Procuratorate learned through investigation that Yu was a first-time offender. After psychological test and understanding of family situation, Yu met the conditions of non-detention, that is, he contacted a company in Shanghai and put Yu in the "Sunshine Base" of the company for a three-month pre-litigation inspection. Because of its outstanding performance, after the inspection period, the procuratorate made a decision not to prosecute and was hired as a formal employee of the company. The Shanghai Procuratorate said that after the establishment of Shanghai's unchecked work organization, it will continue to maintain the innovative exploration of Shanghai's unchecked work, conscientiously implement the criminal justice policy of combining leniency with severity, promote the introduction of a system suitable for adults to participate in litigation and criminal reconciliation in juvenile cases, actively explore new mechanisms for preventing and correcting juvenile delinquency, and effectively prevent juvenile delinquency.
