Can a criminal case be withdrawn after it is filed?

A criminal case can be withdrawn after it is filed, but the parties cannot withdraw it. Only the public security organs can drop a criminal case.

If the public security organ believes that there are criminal facts, meets the standards for criminal case filing, and falls within the jurisdiction of its own unit, it shall file a case for investigation in accordance with the law. If a case is found to have circumstances specified in Article 16 of the Criminal Procedure Law during the investigation, it may be dismissed.

Article 15 of the Criminal Procedure Law: Anyone who falls under any of the following circumstances will not be held criminally responsible. If the investigation has been completed, the case should be withdrawn, or no prosecution should be instituted, or the trial should be terminated, or the case should be acquitted:

(1) If the circumstances are obviously minor and the harm is not great, it shall not be considered a crime;

(2) The crime has passed the statute of limitations for prosecution;

(3) The person has been exempted from punishment by an amnesty order;

(4) The crime should be prosecuted according to the criminal law, Failure to report or withdrawal;

(5) Death of criminal suspect or defendant;

(6) Exemption from criminal liability under other laws and regulations.

Article 206: The People's Court may mediate private prosecution cases. Before sentencing, the private prosecutor may reconcile with the defendant or withdraw the private prosecution. Mediation is not applicable to cases specified in Paragraph 3 of Article 204 of this Law.
