According to the new Criminal Procedure Law, persons under residential surveillance who are suspected of leaking state secrets need approval from the investigative agency to hire a lawyer.

According to the new Criminal Procedure Law, approval from the investigative agency is not required.

Only in the new Criminal Procedure Law, lawyers’ interviews with suspects of three categories of crimes endangering national security, terrorist crimes, and major bribery crimes who are detained or under residential surveillance require the approval of the investigation agency.

The crime of leaking state secrets does not fall into these three categories of crimes and has been deleted. Therefore, no permission is required to meet with the investigative agency.
