According to the provisions of the Lawyers Law, an application for issuing a lawyer's practice certificate shall meet the following conditions:
(1) support our constitution;
(2) Obtaining the qualification as a lawyer;
(3) Internship in a law firm for one year;
(4) Good conduct.
In any of the following circumstances, a lawyer's practice certificate shall not be issued:
(1) Having no or limited capacity for civil conduct;
(2) Having been subjected to criminal punishment, except for negligent crimes;
(3) Being expelled from public office or having his lawyer's practice certificate revoked.
First-time judges adopt a strict examination method and are selected from those who have passed the national unified judicial examination and are qualified as judges according to the standard of having both ability and political integrity. The president and vice-president of the people's court shall select candidates from among judges or other persons with the qualifications of judges.
First-time prosecutors adopt a strict examination method, and according to the standard of having both ability and political integrity, they are selected from those who have passed the national unified judicial examination and are qualified as prosecutors. The chief procurators and deputy chief procurators of the people's procuratorates shall be selected from among the public procurators or other personnel who have the conditions of public procurators.
1, what is the judicial examination?
The national judicial examination is a qualification examination organized by the state to engage in a specific legal profession.
Newly appointed judges, prosecutors and lawyers must pass the national judicial examination.
2. What is the registration time and examination time for the judicial examination?
The national judicial examination is held once a year. The annual judicial examination will be held on Saturday and Sunday in the third week of September every year.
(1) Registration time
1.2006 National Judicial Examination is predicted to be held from June 10 to June 25th. Candidates in areas where online forecasting is implemented can log on to the website of the Ministry of Justice (website:) for online forecasting during the above period. Whether online forecast names are implemented in various places shall be determined and announced by the provincial judicial administrative organs.
2. The on-site registration time for the national judicial examination in 2006 is July 1 -20. If the name has been pre-registered online, it must be confirmed at the registration point designated by the judicial administrative organ of the registration place within the above-mentioned time limit; Applicants who do not apply for online prediction of famous areas shall register at the registration point designated by the judicial administrative organ of the city (prefecture) where the household registration is located within the above-mentioned time limit.
People who work or study outside their residence can register at the place where they work or study. If you graduate from a law school in a relaxed area, register and take the exam in a non-relaxed area or other relaxed areas, and your test scores reach the relaxed qualified score line, you should apply for a legal professional qualification certificate at the place where you live.
Local judicial administrative organs may, according to the actual needs of local registration work, determine the specific on-site registration time within the above time limit and announce it to the public.

3, the main content of the judicial examination
The national judicial examination mainly tests the legal professional knowledge and the ability to engage in legal profession that candidates should possess.
The contents of the national judicial examination include: theoretical law, applied law, current legal provisions, legal practice and legal professional ethics.
In 2006, the national judicial examination adopted a closed-book written examination. The exam is divided into four volumes, each volume 150, with a total score of 600. Test paper 1, test paper 2 and test paper 3 are machine-readable multiple-choice questions, and test paper 4 is written example (case) analysis questions (including legal document writing).
The specific theme of each volume is:
Test paper 1: Comprehensive knowledge. Including jurisprudence, constitutional law, legal history, economic law, international law, private international law, international economic law, judicial system and legal professional ethics;
Examination Paper 2: Criminal and Administrative Legal System. Including: criminal law, criminal procedure law, administrative law and administrative procedure law;

4, the test questions refer to the answer objection
The national judicial examination implements a national unified proposition, and the scope of the proposition is subject to the "2006 National Judicial Examination Outline" formulated and promulgated by the Ministry of Justice.

5. What are the registration conditions?
1. Persons who meet the following conditions may register for the national judicial examination:
(1) has China nationality;

According to the Ministry of Justice's "Opinions on Determining the Place of Relaxing the Qualifications for National Judicial Examination Registration" (No.2 [2002] of our company), autonomous counties (banners) under the jurisdiction of all provinces, autonomous regions and municipalities directly under the Central Government, counties (banners) under the jurisdiction of all autonomous regions and counties under the jurisdiction of all autonomous prefectures; National key poverty alleviation and development counties approved by the State Council; The cities, regions, counties, county-level cities and municipal districts under the jurisdiction of Xizang Autonomous Region can relax their registration qualifications to a junior college degree in law.
According to Article 68 of the Higher Education Law of People's Republic of China (PRC), the aforementioned institutions of higher learning refer to universities, independent colleges and junior colleges, including higher vocational schools and adult institutions of higher learning.

2. Persons under any of the following circumstances can't sign up for the exam, and if they have already gone through the registration procedures, the registration is invalid:
(1) has received criminal punishment for intentional crime;
(2) Being expelled from public office by a state organ;

3. Those who have passed the national judicial examination and obtained the A-class legal professional qualification certificate, and those who have obtained the B-class legal professional qualification certificate but have not yet obtained the bachelor's degree or above in colleges and universities may not register for the national judicial examination again.
6, Hong Kong and Macao residents to sign up for the 2005 national judicial examination related matters.
In order to facilitate Hong Kong and Macao residents to take the national unified judicial examination, the Ministry of Justice agreed to the proposal of the Department of Justice of the Hong Kong Special Administrative Region and the Department of Administration and Justice of the Macao Special Administrative Region, and set up examination areas and examination rooms in the Hong Kong Special Administrative Region and the Macao Special Administrative Region from 2005 to hold the national judicial examination.
Setting up examination areas, examination rooms and holding examinations in Hong Kong and Macao mainly means: accepting Hong Kong and Macao residents to register in Hong Kong and Macao respectively, charging examination fees, choosing to set up examination rooms and organize examinations in Hong Kong and Macao respectively. Examination time, examination subjects, qualification of examination candidates, examination paper system and evaluation, examination results release, examination qualification standard determination, etc. are still implemented according to the unified deployment and requirements of the Ministry of Justice. The specific daily work of setting up examination areas and holding examinations in Hong Kong and Macao can be arranged by the Department of Justice of the Hong Kong Special Administrative Region and the Department of Administration and Justice of the Macao Special Administrative Region to be undertaken by relevant institutions in Hong Kong and Macao.
According to the Provisions of the Ministry of Justice on Residents of the Hong Kong Special Administrative Region and the Macao Special Administrative Region to Participate in the National Judicial Examination, combined with the specific conditions of Hong Kong and Macao residents, the specific matters concerning the registration for the examination are hereby notified as follows:
(1) Registration conditions
1. Identity conditions. China citizens who are permanent residents of Hong Kong and Macao and other China citizens who hold Hong Kong and Macao residents' passes to and from the Mainland may register for the 2005 National Judicial Examination.
In order to confirm the above-mentioned identity of the applicant, when applying for registration, the applicant shall submit the following documents and copies to the institution accepting registration:
(1) Hong Kong and Macao permanent identity cards and SAR passports.
(2) Hong Kong and Macao residents' identity cards, Hong Kong and Macao residents' travel passes to and from the Mainland, and the certificate of "China citizenship has not been renounced" issued by the identity authentication institution of the Special Administrative Region.
At the time of registration, the original of the above documents shall be returned immediately after on-site inspection; The copy is kept by the registered institution. The photocopy of the identity certificate submitted by the Hong Kong applicant must be notarized by a notary public entrusted by China, and the list of notaries entrusted by China can be inquired by the China Association of Commissioned Notaries (Hong Kong); The photocopy of the identity certificate submitted by the Macao applicant must be notarized by the notary department of the Macao Special Administrative Region or a notary institution recognized by the mainland.
2. Education. China citizens who are permanent residents of Hongkong and Macao, who hold academic certificates of mainland institutions of higher learning, can apply for registration directly to the registered institutions; Holders of academic certificates from institutions of higher learning in Hongkong, Macao and Taiwan Province or foreign institutions of higher learning must also submit certificates issued by the Study Abroad Service Center of the Ministry of Education. Hong Kong and Macao residents who have completed their studies but have not yet obtained their diplomas due to academic reasons may apply for academic certification with the diplomas issued by their institutions. After the academic qualification certification, you can apply for registration with the institution that accepts the registration, but you must make relevant commitments as required.
In order to facilitate Hong Kong and Macao residents to apply for academic certification, before the registration begins, the Study Abroad Service Center of the Ministry of Education will accept the applicants' applications for academic certification in an appropriate way. For details, please refer to the website of the Center (China Study Abroad Network, website:). Valid certificates and photocopies that meet the above requirements must be submitted when registering. The original academic certificate and the original academic certificate shall be returned after on-site inspection; The copy is kept by the registered institution.
(2) Place and method of registration
Hong Kong and Macao residents who work, study or live in Hong Kong and Macao should register at the registration point designated by the institutions undertaking examinations in Hong Kong and Macao. The specific registration place and time will be announced separately.
Hong Kong and Macao residents who work, study or live in the Mainland may register in Hong Kong and Macao, or at the registration point designated by the judicial administrative organ of their place of residence in the Mainland, and submit relevant materials as required. To register in the Mainland, you must submit proof of working, studying or living in the Mainland.
In 2005, the national judicial examination did not implement online name prediction for Hong Kong and Macao residents.
(3) Examination place
Candidates who register in Hong Kong will take the examination at the local examination room decided by the institution undertaking the examination in Hong Kong; Those who register in Macao will take the examination in the local examination room determined by the institution undertaking the examination in Macao. Those who register in the mainland will take the exam in the examination room set up by the judicial administrative organ in the mainland.
(4) Other matters.
In 2005, the national judicial examination papers were printed in simplified characters. Candidates from Hong Kong and Macao can choose to use traditional Chinese characters or simplified Chinese characters when filling in their own information and answering questions. Other relevant information about Hong Kong and Macao residents taking the 2005 national judicial examination can be found on the website of the Ministry of Justice. Candidates can directly consult the institutions that undertake the examination organization in Hong Kong and Macao about matters related to registration and participation in the national judicial examination.
7. Registration materials and procedures
The applicant shall submit the following materials when registering:

2. The original and photocopy of my valid ID card (resident ID card, military officer's card and soldier's card).
3. The original and photocopy of my diploma.
Applicants with academic qualifications from Hong Kong, Macao and Taiwan and foreign institutions of higher learning must also submit the certificate of academic degree certification issued by the International Student Service Center of the Ministry of Education.
4. I recently took 3 photos with negative film 1 inch color bareheaded certificate.
Where conditions permit, you can take photos by digital photography when you register.
5. Applicants should pay the registration fee when registering.
The above registration materials are true and complete, and if they meet the registration conditions after verification, the judicial administrative organ shall issue an admission ticket.
8. Test scores and qualification awards
The national judicial examination shall be marked uniformly throughout the country. After marking, the examination results will be announced by the National Judicial Examination Office of the Ministry of Justice.
According to the Measures for the Implementation of the National Judicial Examination (for Trial Implementation), the number of qualified people and qualified scores of the national judicial examination in 2006 shall be determined and published by the Ministry of Justice after the examination, in consultation with the Supreme People's Court and the Supreme People's Procuratorate.
Those who pass the national judicial examination shall be awarded the legal professional qualification certificate by the Ministry of Justice. A person who has passed the examination and obtained a legal professional qualification certificate shall meet other conditions stipulated in the Judges Law, the Prosecutors Law and the Lawyers Law before he can serve as a judge or prosecutor and obtain a lawyer's practice certificate.
