Who is responsible for the accident when the electrician goes to work without a license?

According to the relevant judicial interpretation, if an unlicensed electrician takes up his post and causes damage to others, the employer shall bear joint liability with the electrician.

In real life, due to the disparity in economic status between the two parties, victims generally choose to recover from their employers, who can recover from employees who are intentional or negligent after assuming joint and several liability for compensation. In addition, according to the provisions of relevant judicial interpretations, if an unlicensed electrician himself is killed or injured in the accident, the employer shall bear civil liability for compensation according to the severity of the accident, and even pursue criminal responsibility for the crime of major liability accident. Low-voltage electricians and high-voltage electricians, as well as aerial work, all need formal training and study, and refer to the examination organized by the State Administration of Work Safety. State administration of work safety (Emergency Management Department) will issue training certificates to those who pass the examination, and the certificates will be reviewed once every three years. Take the exam training again in the sixth year, and issue a new certificate if you pass the exam.

Some unlicensed electricians should not take chances, thinking that they can escape, and once something happens, they will definitely regret it. Employers are also obliged to check whether the other party is certified every day.

Article 97

Production and business units have one of the following acts, shall be ordered to make corrections within a time limit and impose a fine of one hundred thousand yuan; If it fails to make corrections within the time limit, it shall be ordered to suspend production and business for rectification, and a fine of 10 million yuan but not more than 200,000 yuan shall be imposed, and a fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed on the directly responsible person in charge and other directly responsible personnel:

(a) failing to set up a safety production management organization, equipped with safety production management personnel and registered safety engineers in accordance with the provisions;

(two) the main person in charge of the production, management, storage, loading and unloading units of dangerous goods, as well as the mining, metal smelting, construction, transportation units and safety production management personnel have not passed the examination in accordance with the provisions;

(3) Failing to educate and train employees, labor dispatchers and internship students about safety in production in accordance with regulations, or failing to truthfully inform them about safety in production in accordance with regulations;

(four) did not truthfully record the safety education and training;

(five) did not truthfully record the investigation and management of hidden dangers of accidents or did not inform the employees;

(six) the emergency rescue plan for production safety accidents has not been formulated or the drills have not been organized regularly;

(seven) special operations personnel have not received special safety operation training and obtained corresponding qualifications in accordance with the regulations, and have been working in their posts.
