How to deal with domestic violence law

A few days ago, a judgment document published by China Judgment Document Network showed that "the first case of domestic violence in China" occurred on 20 15. After the woman suffered domestic violence, she took the man to court and won the case. It is understood that many women are victims of domestic violence cases. Some experts pointed out that although domestic violence is explicitly prohibited by law, it cannot effectively protect women's rights and interests in practice. Domestic violence is a long-term and repeated social problem with no solution. What harm will domestic violence do to women? What should I do with it?

1. Most of the victims are women.

The biggest victims of domestic violence are women, followed by men. The 20 15 White Paper on Domestic Violence in China shows that the victims of domestic violence are mostly women, accounting for only 3.8% of men and 70.6% of women. From June 1965 to June 2006, only 24.8% of women suffered from domestic violence. Because men are more controlling in domestic violence, female victims usually have no resistance. Once the perpetrator does it, it will leave an indelible scar. Experts pointed out that domestic violence exists in a large number of long-term marriages in China, and most female victims in domestic violence cases are passive victims. In addition to physical injuries, women who suffer from domestic violence may even suffer mental trauma.

2. Women suffer mostly from housework.

Women suffer mostly because of "housework", that is, the interference of husbands and in-laws in family affairs. Han Xiao, a Beijing lawyer, said that there is no provision against domestic violence in China's current laws. Therefore, when dealing with domestic violence cases, it usually depends on the emotional situation of both husband and wife. He pointed out that domestic violence is often classified as "violent behavior" rather than "illegal behavior", because in China, it is not easy for husbands to work outside the home to make money, and they should be "responsible" for their wives. According to the provisions of China's marriage law, one spouse may not commit domestic violence against the other. However, when husband and wife often fail to perform their legal obligations in the family, it does not apply to the division of property between husband and wife in divorce proceedings. This is because there are still some legal restrictions on the property relationship between husband and wife in China's marriage and family relations. For example, divorce is not allowed when there is a dispute between the two parties due to family affairs.

The breakdown of marriage is mostly the man's "fault".

Whether a marriage can last long depends on whether two people can face the future together and whether they have the ability to resolve these pressures when facing life pressures. If the marriage breaks up, it is mostly the man's fault. However, even if the court decides to divorce, it is necessary to consider whether the property of both parties is the same during the marriage relationship, the ownership of the property after marriage, the custody of children and other issues.
