Code of practice for lawyers in handling criminal cases

Article 1 In order to guide, standardize and guarantee lawyers to perform their duties according to law in criminal proceedings, this Code is formulated according to the Criminal Procedure Law of People's Republic of China (PRC), the Lawyers Law of People's Republic of China (PRC) and lawyers' practical experience in handling criminal cases.

Article 2 Lawyers shall perform their duties according to law in criminal proceedings, and their personal rights and litigation rights shall not be infringed.

Article 3 When undertaking criminal proceedings, lawyers must abide by national laws and regulations, take facts as the basis, take laws as the criterion, and abide by lawyers' professional ethics and practice discipline.

Article 4 In criminal proceedings, lawyers must be loyal to their duties, be conscientious and responsible, and safeguard the legitimate rights and interests of the parties according to law.

Article 5 Lawyers shall act as defenders or provide legal aid to criminal suspects, and conduct litigation activities independently according to law, and shall not be restricted by the will of the parties.

Article 6 When handling criminal cases, lawyers shall keep state secrets and commercial secrets of the parties concerned, and shall not disclose the privacy and other secrets of the parties concerned.

Article 7 A lawyer shall not accept the entrustment of two or more criminal suspects and defendants in the same case to participate in criminal proceedings, nor shall he act as the agent of both parties in the same case of private prosecution and criminal incidental civil action.

Article 8 Lawyers shall not accept cases or charge fees without permission.

Article 9 When undertaking criminal litigation business, lawyers may entrust lawyers from different places to investigate and collect evidence on their behalf, or request lawyers from different places to assist in meeting criminal suspects and defendants. Lawyers from different places should support them.
