Article 259 of the "Criminal Law of the People's Republic of China"****, People's Republic of China: Anyone who knowingly lives with or marries the spouse of an active military member shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. Anyone who takes advantage of his position to coerce others to commit adultery with the wife of an active military member shall be convicted and punished in accordance with the provisions of Article 236 of the Criminal Law. On January 24, 2022, the Gujiao City People's Procuratorate filed a public prosecution with the Gujiao City People's Court on Hu's suspicion of sabotaging a military marriage and Wang's suspicion of bigamy. On March 3, 2022, the court adopted the charges and sentencing recommendations of the public prosecution and sentenced Hu to nine months in prison for the crime of disrupting military marriage; and sentenced Wang to one year in prison for bigamy. Wang and Hu showed remorse and did not appeal.
The particularity of the military profession and mission determines that their marriage and family relationships are different from ordinary families. Therefore, our country’s laws provide special protection to military marriages. This protection is what makes it different from a regular home. In ordinary families, cheating or cohabitation within marriage will not be punished by law. Only bigamy will be punished by criminal law, but as long as a military family is destroyed, criminal responsibility will be borne!
